The head of the nation’s immigration enforcement agency said Tuesday that the decision to release over two thousand detained illegal immigrants was done for budgetary reasons alone and independent of political pressure, pushing back against critics who claim the Obama administration publicized the release of criminals to highlight the consequences of budget sequestration.
“There are no mass releases of dangerous criminals underway or any plan for the future, just efforts to live within our budget,” Immigration and Customs Enforcement Director John Morton said in testimony before the House Judiciary Committee.

Morton, who was quizzed by another House committee last week, said that only four of the released detainees are “Level One” criminals -- those who pose the highest level of threat – while over 70 percent of the 2,228 individuals released have no criminal record at all. All of the released detainees are still in proceedings for removal from the United States, he added.
Some Republicans have accused the agency of allowing the releases to take place for political reasons after automatic budget sequestration cuts slashed the agency budget by about $300 million.
Morton said Tuesday that the cuts to detention levels were required because he did not want to “rob Peter to pay Paul” within ICE’s reduced budget, testifying that the decision was made by ICE officials without prior communication with Department of Homeland Security head Janet Napolitano.
“I am trying to live within the appropriations that Congress gives us,” he said.
At Tuesday's House Judiciary Committee hearing, Rep. Trey Gowdy, R-S.C., engages in a tense exchange with ICE Director John Morton about the release of illegal immigrants from detention.
That explanation didn’t satisfy Immigration and Border Security Subcommittee Chairman Rep. Trey Gowdy, R-S.C.
“I don’t want Peter or Paul to rob one of our fellow citizens because you guessed wrong on who to release,” Gowdy replied.
While Morton, who has served as the head of ICE since 2009, mostly got a friendly reception from Democrats, he was the target of tough words from Rep. Luis Gutierrez of Illinois, a congressional leader on the push for comprehensive immigration reform and a critic of the Obama administration’s deportation policy.
“The fact is, you’ll deport 1400 people today, you’ll deport 1400 people tomorrow and the next day and the next day until we do comprehensive immigration reform,” Gutierrez told Morton, citing record deportation numbers during the ICE director’s tenure. “Two hundred and fifty to 300 American citizen children are going to be left today -- because of your actions and those in your department – without a mom or a dad.”

A lot of you on here are misinformed about the whole deportation issue. Let me set straight some of the misinformation here:
Homeland Security asks Congress for $141 per person per night to detain someone tagged as illegal. Comes up to roughly $51,000 per person per year. That's taxpayer money; let me make that clear.
Private for-profit deportation camps warehouse these people for between $40 and $90 a night-- $14,000-$32,000 a year. Homeland Security keeps the rest.This is added into their budget along with money from the sales of the confiscated personal belongings from those being deported-- it's called 'civil asset forfeiture'; when you go into a deportation camp they take everything you own and sell it at government auction.
Congress passed a law back in 2007 that said Homeland Security has to decide on a detainee's case within six months--Homeland Security routinely ignores this law; there have been documented reports of people held for up to five years.
An immigration detainee with no criminal record and/or who is determined to pose no threat to the public can be released with an ankle monitoring bracelet--they also have curfews, movement restrictions and required check-ins with a federal parole officer. Keep in mind also that many of the people held on an immigration retainer have broke no laws. Examples:
*children adopted from overseas whose adoptive parents were given falsified papers by crooked adoption agencies who pocketed the money instead of getting real papers- current procedure is to take these children (as young as 18 months) and detain them in Unaccompanied Minor (UAM) deportation camps. There aren't many of these camps and these children sometimes end up across the country from their adoptive parents and the adoptive parents' lawyers, and they don't have the right to Child Protective Services advocates.
*When you show up at a border checkpoint and ask for asylum, you are immediately taken into custody and sent to a camp as an arriving alien. You have committed no crime, you haven't come illegally, you have asylum paperwork in process and are just waiting for a hearing-- which can take up to five years.
* You have come here legally and filled out renewal paperwork for your visa/green card. Your paperwork does not get to the office on time, or it is sent to the wrong department in USCIS, and by the time it gets to where it's supposed to go, your paperwork has missed the filing deadline.You have been tagged as 'illegal' and a deportation order has been issued for you in absentia--without your knowledge; you have no idea until you're picked up as an illegal, you tell them you sent in paperwork, and find out that it missed a deadline.
*A woman was adopted from Germany in the 1940's; Immigration at the time sent a letter to adoptive parents telling them that citizenship was taken care of and they did not have to file. 60+ years later, USCIS discovers their mistake. Instead of allowing the woman to file paperwork to correct Immigration's mistake, she is deported to Germany and will have to remain there for 10 years before her son can apply to bring her back. Her now-90-year-old adoptive parents will never see her alive again.
*An infant was adopted internationally by US citizens, who passed away in a car accident never having told the child she was adopted. USCIS does a routine record search one day, finds out that the adoption paper has been lost from this folder and goes to the child, just turned 18, for a copy. This teen has no idea she was adopted; she is tagged as 'undocumented' and sent to a deportation camp, only for USCIS to find that the child was abandoned as an infant and there is no original birth certificate with country of origin--and so she cannot be deported because there is nowhere to send her. She is told she will remain in deportation until she gives them the missing adoption paper.
There are also cases where someone has been declared a citizen and proved the are legal but immigration continues to hold them:
*The son of a decorated Vietnam veteran, Hector Veloz is a U.S. citizen, but in 2007 immigration officials mistook him for an illegal immigrant and locked him in an Arizona prison for 13 months. Veloz had to prove his citizenship from behind bars. An aunt helped him track down his father's birth certificate and his own, his parents' marriage certificate, his father's school, military and Social Security records. After nine months, a judge determined that he was a citizen, but immigration authorities appealed the decision. He was detained for five more months before he found legal help and a judge ordered his case dropped.
*Mr. Ibarra, 46, was born in Mexico but was raised since infancy in Arizona. In his late 20s he enlisted in the Marines and served three years on active duty, including time in Iraq, before being honorably discharged. On February 23, 2011 Department of Justice adjudicator Richard Phelps ruled in Eloy, Arizona that George Ibarra had by a preponderance of the evidence proven that he is indeed a citizen of the United States. Rather than rely on this determination and apologize to Mr. Ibarra for previously wrongfully deporting him, the Department of Homeland Security (DHS) is holding Mr. Ibarra in solitary confinement at the Eloy Detention Center, in clear violation of the U.S. Constitution and a memorandum requiring Immigration and Customs Enforcement (ICE) to release anyone with "probative evidence" of U.S. citizenship.
*Hans Joachim Keil was arrested in Dutton in September and accused of being an illegal alien. He was an official representative of Samoa, a current Member of Parliament and a prominent businessman with many family links. He had diverted to Missouri on the way home from trade talks in Brussels where he represented Samoa. “They were going to lock me up for five years plus five years. Five years for impersonating a US citizen and five years for using an illegal US passport. On the day of my arrest when I brought to their attention, that I served in the US military … they threw that out the window and said that I’m an illegal alien and I have no right to be in the United States. They knew I was a Samoan diplomat but they had no regard for my diplomatic passport.”

Homeland Security's last reported budget was $98 billion. This is spread out over many departments like TSA, FEMA, the Coast Guard, CBP, ICE, USCIS, the Secret Service, the National Communicatons Center, the National CyberSecurity Office, the Office of Legislative Policy, the Office of Civil Rights and Civil Liberties.
Many of those tagged 'illegal' have never broken laws nor been convicted of crimes:
An official Immigration and Customs Enforcement database, obtained under the Freedom of Information Act, showed a U.S. detainee population of exactly 32,000 on the evening of Jan. 25.
The data show that 18,690 immigrants had no criminal conviction, not even for illegal entry or low-level crimes like trespassing. Substantial numbers of detainees, from 177 countries in the data provided, are not illegal immigrants at all. Many of the longest-term non-criminal detainees are asylum seekers fighting to stay here because they fear being killed in their home country. Others are longtime residents who may be eligible to stay under other criteria, or whose applications for permanent residency were lost or mishandled, the lawyers say.
Based on the amount budgeted for this fiscal year, U.S. taxpayers will pay about $141 a night -- the equivalent of a decent hotel room -- for each immigrant detained, even though paroling them on ankle monitors -- at a budgeted average daily cost of $13 -- has an almost perfect compliance rate, according to ICE's own stats.
And they aren't ignoring the laws, they're actually now getting around to following the laws. Per my post at 1.44:

It's already been shown that the sequester was the administration's idea. Since Obama brought the knife and stuck it in his own chest, why do you insist on trying to make it a Republican issue? All they needed was a ride to the border.

The problem with sequester is that there is NO language in the law that allowys moving money from one department/program to another. There is strict language that ALL departments must have a certain % reduction. Thus the release of "criminals" was predetermined. The Obama administration has no intention of implementing the sequester in good faith. He talks a good game about not "kicking the can down the road," but when it comes right down to it, he has no intention of making good on that claim. He wants more taxes (and he already got some of them). But he has absolutely no interest in hunkering down with his department heads, rolling up his sleeves, and making reasoned spending cuts and efficiency improvements that would comply with the sequester. That would be contrary to his overall strategy of blaming the evil "millionares and billionares" for the nations ills.
Even with the sequester, total federal spending in 2013 will exceed 2012, and agency discretionary spending will still be greater than 2008 levels. In a time of very low inflation, these "cuts" are no more than slivers or pinpricks. The average American family has had to weather far greater income reductions in that time.
Rather than spread these modest cuts as widely and broadly as possible, the cuts will come down in the ugliest and most public manner possible. No more Blue Angels. No more Thunderbirds. Furloughs for civilian D.o.D. employees. No more White House tours. Cancel the Easter Egg Roll. I bet Obama will cancel Fourth of July festivities in Washington, too.
