Republicans have lashed out against the Obama administration’s decision to bring a son-in-law of Osama bin Laden to New York City for trial, a high-profile move that would help the president follow through on one of his earliest campaign pledges.
One of the unmet promises from President Barack Obama’s first term involved closing the terrorist detention facility at Guantanamo Bay, Cuba, and bringing suspects to the continental United States for trial.

Two days after his first inauguration, the president signed an executive order calling for the closure of the military prison. But bipartisan resistance from lawmakers, who feared trials for terror suspects on domestic soil, scuttled efforts to shutter Guantanamo, leaving prisoners and detainees in legal limbo.
Four years later, Guantanamo remains in operation, and military tribunals – 9/11 mastermind Khalid Sheikh Mohammed’s trial is ongoing – continue at the naval base in Cuba. But the Obama administration’s decision to arraign a son-in-law of Osama bin Laden, Sulaiman Abu Ghaith, in federal court on Friday in New York marked maybe its most high-profile example of working to shift terror prosecutions to civilian courts.
Osama bin Laden's spokesman and son-in-law, Sulaiman Abu Gaith, was arrested in Jordan by U.S. intelligence officials and has been brought to New York to face terrorism-related charges. NBC foreign correspondent Ayman Mohyeldin joins Morning Joe to discuss why this is significant and why some are saying this shouldn't be happening in New York City.
And already, Republicans are mounting stiff resistance to the move.
Sen. John McCain, R-Ariz., who on Thursday took to the Senate floor to defend Obama’s prerogatives in waging drone strikes, vowed to fight the administration’s decision to bring Abu Ghaith to New York.
"The American people and their representatives in Congress have been clear that they do not want foreign members of al Qaeda brought to the United States,” he said in a statement. “The Obama administration's decision to try Abu Ghaith in a New York district court clearly contravenes the will of the American people. This decision by the Obama administration will not go unchallenged."
The issue of Guantanamo is one on which Republicans have built a rare political advantage over Obama on an issue of foreign policy. Their dogged opposition to terror trials on U.S. soil has won over a handful of Democrats, thereby stymying the administration’s ability to execute one of the president’s first official orders.
And following Abu Ghaith’s “not guilty” plea this morning to charges of plotting to kill Americans, Republicans have piled on in short order.
“What has not changed since the issuance of the president's executive orders is that terrorists working to attack the United States are enemy combatants, and if captured should be placed in military custody where they can be interrogated,” Senate Minority Leader Mitch McConnell, R-Ky., said in a statement. “The decision of the president to import Sulaiman Abu Ghaith into the United States solely for civilian prosecution makes little sense, and reveals, yet again, a stubborn refusal to avoid holding additional terrorists at the secure facility at Guantanamo Bay despite the circumstances.”
Added Republican Rep. Peter King, the New York congressman who’s been vocally critical of terror trials in New York: "While a federal court trial of Abu Ghaith in lower Manhattan would not present the same security issues as a trial of Khalid Sheikh Mohammed, I strongly believe as a matter of policy that military tribunals are the proper venue for enemy combatants. If the Abu Ghaith trial does go forward in federal court it must not be used as a precedent for future enemy combatants who should be tried at Guantanamo."
With Congress out of town, few Democrats have chimed in on the Abu Ghaith decision; he was only extradited on Thursday. Several Democrats, like Manhattan Rep. Jerrold Nadler, D-N.Y., have in the past been vocally supportive of civilian trials in New York.
"I support the government bringing this prosecution in civilian court and expect that the federal prosecutors in the Southern District of New York will successfully prosecute Abu Ghaith and put him away for the rest of his life," Sen. Dianne Feinstein, the Democratic chairwoman of the Senate intelligence panel, said in a statement. She has previously supported trials for terror suspects in the United States. "The bottom line is the federal criminal court system works. Hundreds of international terrorists have been convicted in our federal courts since 9/11 and are locked away in heavily fortified federal prisons."

Deputy White House press secretary Josh Earnest, though, used Friday’s briefing with reporters to push back against criticism of the move.
“The intelligence community agrees that the best way to protect our national security interests is to prosecute Abu Ghaith in an Article III court,” Earnest said, later adding: “This is somebody who's going to be held accountable for his crimes and will be done -- and that will be done in accordance with the laws and values of this country, and it will be done so in a pretty efficient way.”

Okay, maybe you can explain this. The detainees are combatants because they were caught trying to wage war on the US. But they're not combatants, so they're not bound by the Geneva Accords prohibiting torture. Tell me, which one is it? Oh, right, it's the CONVENIENT AT THE TIME argument that matters, right?
As far as trying these guys in a US Court, I'm on the fence. I mean, our courts and our rights are explicitly only for American Citizens. These guys aren't citizens, so they don't have any of our rights. By the same token, the jurisdiction for the courts are not entirely limited to citizens, as they also deal in international law. I guess the best thing to do would not be to try them in the American method, but use our courts to try them under International Law. Or, better, convene a specialized court to try them, like at Nuremberg. And anyone who tries to equate the courts at Nuremberg with the one at Guantanamo Bay needs to do several things, starting with having your head removed from your rectum.

I've heard that argument before...the Gitmo Detainees aren't citizens and therefore aren't entitled to the rights of a citizen. However, for that argument to truly be valid it would mean that our Constitution applies to citizens only. While it is correct that the Constitution does not apply to non-citizens, it is also correct to say that the Constitution does not apply to citizens.
This is because the Constitution applies to the government of the United States of America. It is a series of rules by which the government shall conduct its business.
Think of it this way...is Freedom of Speech granted by the Constitution? No...you have Freedom of Speech already and the Constitution guarantees that by saying that Congress shall make no law "abridging the freedom of speech".
So, like it or not, the Constitution guarantees due process.

After all Obama had a super-majority in Congress for plenty of time to get it done. The fact is that he tried dispersing those in custody to other nations but nobody would take them. The Senate handily controlled by Democrats voted 90-6 against appropriating $80 million to close Guantanamo. He then tried to buy a prison in Illinois to house the detainees. The House Armed Services Committee then controlled by Democrats UNANIMOUSLY approved legislation that would prohibit creating a detention center inside the United States. Operative words? "Democratic control"..."unanimously". The attempt to try Kahlid Sheik Muhammad was not shot down by the Republicans it was undermined by the City of New York which is controlled by Democrats. The Obama administration decision to resume the military commissions was his own and was made while Congress was still controlled by the Democrats.
So stop you disingenuous sobbing. Obama and the Democrats could have gotten it done, but it was the DEMOCRATS who controlled Congress that blocked him and then he lost his will and just gave up.
The Geneva Convention states that prisoners of war have certain rights. OK, good. But the Geneva Convention (especially the Fourth Geneva Convention, 1949) is all about hostility between nations. Al Qaeda is not a nation - it is a terrorist group. Making these murderers "soldiers in a war" gives them a legitimacy they do not deserve. They are simply criminals, international criminals. No military tribunals for these scum, they are only common criminals and should be treated as such.

Yes, I would technically prefer a military tribunal, but it doesn't really make that much of a difference. One way or another, the guy is going to be thrown in jail. Besides, trying him in a civilian court tells the world that we are not vengeful savages like the terrorists who have blown our people to bits; it shows that we are better than they are. And isn't that the point of this war? To win the support of the world? If we act like the very men who seek our deaths than what is the point in fighting?? A) When you have a super-majority, 6 months is long enough to get anything you want done.
B) The only time 60 votes is needed for cloture is when there are no vacancies. When you have 59 caucusing Senators out of 99 seated, you have enough to invoke cloture meaning you had a super-majority from April 30, 2009 through Feb 4 2010.
C) As noted, if the Senate ramming through Obamacare proved anything it is that a super-majority is not need to push through any legislation that one party wants. All they need is to hold a majority of seats in both houses of Congress and the Presidency. Add one single tiny budget item and walla...no delay tactics.
D) Filibustering doesn't kill a bill, it just delays it. The longest filibuster on record was Democrat Strom Thurmond filibustering the Civil Rights Act of 1957 and was only 24 hours and 18 minutes. So you're going to let an important bill die because you have to wait a day or two? Seriously?
This doesn't even account for the fact that Congressional consideration of this matter is a mute point. The detainees of Guantanamo were under the control of Cabinet departments (Defense/Justice). They could have been moved anywhere within those departments on the directive of the Obama administration They could have been moved to any federal prison or military prison and Congress could have done nothing about it short of passing a law restricting the move of the detainees...which they didn't. And of course HE didn't either, passing up his chance to follow through on his campaign promise.

As I stated and as is documented in Senate rules, the only time 60 votes are a requirement for cloture in the Senate is when ALL 100 SEATS ARE FILLED. Not sure how many times that has to be said before you stop ignoring that reality. When less seats are filled, you don't need 60 votes to have a super-majority. With one seat vacant (making only 99 seats filled) the 59 Senators caucusing with the Democrats formed a super-majority that could have ended any type of delay the opposition threw at them. The Senate rounds all such figures so 59 / 99 = 59.59% = 60% = 3/5. This super-majority started on April 30th with 59 of 99 Senators caucusing with the Dems.
This AGAIN leaves only 99 seated Senators meaning only 59 were needed to invoke cloture. The super-majority remained based on the rounding rules of the Senate and 59 of 99 Senators caucusing with the Dems.
This is the first date since April 30th, 2009 that Democrats were no longer a super_majority and numerically unable to invoke cloture meaning -- as I clearly stated in my post -- that Dems had a super-majority from April 30th, 2009 through Feb 4th, 2010.
I think what the Republicans really want is to round up all Bin Ladens currently in the country and re-unite them with their families. Just like after the 9/11 attack on the WTC.

During the Bush years, there was a policy of paying Iraqis and Afghans to turn in their neighbors for contact with terrorists. If someone disliked his neighbor, all he had to do was turn him in and get paid, and his neighbor gets a one way ticket to the tropical paradise known as Gitmo, where he comes in contact with real terrorists. Add to that, once in Gitmo, you're guilty until proven innocent, so a person who's only crime was having a feud with his neighbor gets indoctrinated in AQ's world.

Dems both held and controlled that seat.

What does Obama, McCain, Republicans, or Democrats (and the associated hatred that comes from the mouths of posters on this thread) have to do with this issue? The issue is very simple and straightforward: Should terrorists be tried in a U.S. Civilian Court or in a Military Court. It seems to me that anyone waging war against the U.S., whether it is a country or a foreign group of people dedicated to the destruction of our nation, should be considered enemy combatants. And if the Constitution does not make that clear, then it is time for a new Amendment. Enemy combatants should be tried in a Military court. The side benefits would be a quicker sentence, cost effectiveness, and better security that is already in place.
The Geneva Conventiion classifies terrorists as "unlawful combatants". It is this justification Obama uses as the basis for his drone strikes. Ask Obama if he thinks "we are not a nation at war".
After McCain embarassed himself yesterday by showing support for willy-nilly drone strikes against Americans on American soil, one would think he would have the wisdom to shut his trap.

I can't say I'm in favor of trials on US soil; it's one thing to not be fearfull of terrorists and another to invite trouble. Also, this isn't the time for costly undertaking by government or private enterprise that's really not necessary if the right decision is made.
I would agree that an international court of sorts could take care of this and clean up the gitmo problem. If for some reason those found guilty are allowed to breathe then all can share in those expenses for life imprisonment, including the building of some facility if none exist.
Of course America was severely and in my mind most seriously affected, but others were and may feel similarly as well. Any that deny there's some degree of publicity to this US trial bit are in denial. For too long, people behind closed doors have been determining policies that affect our lives and rights. McCain as with others on the committee want to determine policy in regards to the treatment of US citizens behind closed doors and out of the media. That is how NDAA originally got passed with language that opened the door. When he asked questions of the future CIA director Paul was fully in his rights to get an answer. When the President, the Attorney General, and Brennan refused to give a clear answer to a simple question Paul did the only thing he could to bring attention to the subject before it was too late.
You may not like what Paul did, or how he went about it, but I am proud that there are a few elected officials that don't care about politics and attempt to do what is right, for rights sake. In today's world they are few and far between that will break with party and actually have values.

The cost of the average prisoner in a federal prison in the United States is $25,000 per year. The cost for a single Gitmo detainee is $800,000 per year. As of September 2012, 167 detainees remain in Gitmo. So, you do the math...would you rather spend the approximately $133.6 Million to keep them in Gitmo or the $4.175 Million to have them in the regular federal prison system?

If he could no longer even make it to Washington for a simple 30 minute cloture vote, all Kennedy would have to do is to have stepped down and another Democrat would take his place. After all the Democrat Governor would have immediately appointed a Democrat to take Kennedy's seat (which he did upon Kennedy's death).
Kennedy's seat had one role at that point. Occasionally come in for 30 minutes and vote to invoke cloture. That's all he had to do. If he was too incapacitated to do even that then the Dems should have asked him -- or he should have volunteered -- to relinquish his role.

Knowing "facts" in isolation can be misrepresentative, and easily regurgitated I look for surrounding facts and context. I look for supporting statistics and consider the source and possible bias of the statistics. I look to see if there are multiple sources of statistics to get a statistical consensus. I seek truth and the truth breaks conservative.

If enemy combatants belonging to no Army representing any such sovereign Nation by Geneva code become incarcerated within the same military prison. It poses too much of a logistical risk with all combatants being within the same location for possibility of organizing covert plans against their American military captors, together. In addition, a plan would be logistically easier for any rescue operation by any commando rescue force.
If Terrorists were prosecuted and incarcerated in Federal prisons throughout America. It would be much better. Those prisoners could be moved to many different locations. Multiple combatants could be housed in multiple different locations making it nearly impossible for any opposing force attempt at organizing rescue efforts. And, best yet, Terrorists would be incarcerated with the American gang population that infests American prisons.

Back, I have thought about voting third party before, but that would in effect be as effective as staying home. If a third party wants to have a voice in the debate, they have to start small. Work on putting people in the House and Senate. You're trying to take voters from two established parties. After you get a decent foothold in congress, then you have someone you can caucus with, and perhaps get converts from dissatisfied members of the established parties. I'm not averse to having other voices, but you have to separate yourself from the ones you're going to run against.
Why send him anywhere? I believe NYC can execute him for crimes against the US, just as easily as somewhere else. Why would you assume he would get life in prison? As we did with most of the leaders in Germany for crimes such as terrorism and against humanity, we execute them. I have no problem with that.

Because this evidence was disallowed, the jury only convicted on one single conspiracy count. Ghailiani was acquitted of a whopping 284 other charges including the murder of 224 people including 12 Americans. If the civilian judge had seen fit to disallow one more critical piece of evidence, he would have walked a free man.
If tried in a court in the states, republicans are deathly afraid Osamas son-in-law might reveal something about 9-11 they don't want revealed.

The source quoted for this sale was a drunk who had been proven to embellish if not outright fabricate information before. This sale was shown to be bogus, but still used to justify the attack on Iraq. Needless to say, there was never a trace of one ounce of this 500 tons of uranium ever located. As for why the Democrats voted for the invasion, the Bush administration made sure that anyone who didn't support their policies would be labeled as a traitor, and that would be a death sentence for anyone's political career right after 9/11.

Jason, the security in and around the courtroom will be unprecedented. But NYC in and of itself is just as vulnerable as any other large city.
Remember, the track record of terrorists being convicted in a civilian court rather than at a military tribunal is higher. We all want to see the guy convicetd, but why risk the conviction being overturned. There have been Guantanamo convictions overturned in the past.

On your court room security theory; a determined terrorist who is seeking a glorious death isn't afraid of any security measures. He doesn't have to blow up the courtroom to make his point. He just needs to get to the security checkpoint and then detonate. If they are smart, the will conduct a wave attack, with the first taking out security, and follow on attackers going deeper into the court complex to cause more death and destruction. That's how they manage to get into secure buildings overseas.

The War Powers Resolution of 1941 prevents the president form doing it by putting a time limit on his actions. The War Powers Resolution requires the President to notify Congress within 48 hours of committing armed forces to military action and forbids armed forces from remaining for more than 60 days, with a further 30 day withdrawal period, without an authorization of the use of military force or a declaration of war.
And I don't remember reading that the Supreme Court of the United States is authorized to declare war. So, I think we've pretty much covered the branches of government...right Bill?

By doing it the old fashioned way, we stick to our principles (no torture, innocent until proven guilty, etc) and take away said rhetoric. Yeah, my family has fought in every conflict since the REVOLUTION. I come from a military family and think that giving this man a military trial would be granting legitimacy to his "cause" instead of exposing him for the apostate he is (he does not actually follow Islam as it is supposed to be followed - then again the MAJORITY of Christians in the US do not actually follow Christ - they follow Paul). This man is NOT an enemy combatant by definition. He does NOT fight for any Nation. We have NOT declared war on ANY nation. He was NOT captured in open conflict with our forces. He doesn't fit any of the definitions, therefore he gets a civil trial.
