Woman changes story, denies being paid for sex with Sen. Robert Menendez

SANTO DOMINGO, Dominican Republic - A Dominican woman who previously stated in a video that she was paid to have sex with Senator Robert Menendez of New Jersey now says the allegations were false, according to a sworn statement released by a lawyer on Monday.

The notarized affidavit was distributed by a prominent Dominican lawyer and friend of Menendez, Vinicio Castillo, who said it had been handed over to prosecutors. Castillo is not acting as the lawyer to the woman.

In her sworn statement, Nexis de los Santos Santana denied ever meeting Menendez and said she never agreed to be filmed.

New Jersey Sen. Robert Menendez is addressing allegations that he hired a prostitute on a trip to the Dominican Republic, saying they are "totally unsubstantiated." The campaign donor with whom he traveled is currently under federal investigation. NBC's Kelly O'Donnell reports.

Menendez, a Cuban-American Democrat who chairs the Senate Foreign Relations Committee, won re-election to a second term last year. He has repeatedly denied the sex claims, calling them "politically motivated" smears.

Asked on Monday night about the affidavit, a spokeswoman for the senator declined to comment. The affidavit was first reported by the Washington Post.

The original videotaped interview with the woman features her saying that Menendez paid her for sex and that she was cheated out of the full amount he had agreed to pay.

But according to the affidavit released on Monday, the woman now says she was paid to read from a prepared text and was videotaped without her consent.

No doubt this was a coerced change to the story. Menendez is a politician definitely serving for what is in it for him. Not that Democrats will do anything but circle the wagons around him, moral and ethical problems are only an issue when they occur on the other side of the isle. With people like Menendez serving in Washington, it is pretty obvious why the country is so screwed up.

Weird.....a tape pops up out of nowhere. I think we saw that one before from a Church out west somewhere.....caused some pretty wild riots around the world. Listen conservatives: if you're going to try and destroy a rival, at least pay your actors enough to stick with the story. Granted they may do time, but I know your donors have enough money to make it worth their time. You can't buy elections yet, but you can do a better job of selling these tapes to the general public. Don't be cheap, or they might just go back to telling the truth again.

The justice dept. needs to continue to investigate this until they get to the bottom on it. Clearly the Daily Caller or someone on the GOP campaign paid the women to read a script. This is blatant slander and an attempt to sabotage democracy (the new GOP game). Geez! Talk about a win at any cost strategy. I wonder how much they paid.

Someone patronizing a hooker is 'Who cares' except maybe for the wife. Someone paying a prostitute to falsly accuse a senator in an attempt to force him to resign is serious business and should be investigated by the FBI. So when she was standing in front of the camera and saying she had sex with Menedez how was she being forced to do that? More likely, she was told, in no uncertain terms, that she needs to retract the video statement and sign the affidavit least she disappear! Reporters don't go around forcing people to give statements via video. But those in trouble and their henchmen are all too willing to use whatever means possible to try and dig themselves out of the doo doo. And it won't be long before Menendez is back at it again, because guys like him can not control themselves when it comes to their "hobbies".

North Korea says its nuclear program is a response to U.S. hostility that dates back to the 1950-53 Korean War, which ended with an armistice, not a peace treaty, leaving the Korean Peninsula still technically in a state of war.

North Korea warned it will cancel the Korean War cease-fire agreement on March 11, citing U.S.-South Korean military drills that began March 1.

You speak to this matter with a great deal of authority, King. Has you 'knowledge' of the subject been developed through personal experience or derived from prurient opinion? I find it amusing that so many prejudiced individuals choose to believe a sworn liar while believing the original statement was/is pristine truth. In order to keep their prejudices fed they concoct the belief that this woman was coerced to make her denial but discount the possibility that she was coerced in her original statement. Obviously she is money motivated for that is the basis for her 'expose' about Menendez ~ that she was cheated out of part of her prostitute fee. In other words, according to her, she was "stiffed" ~ ~ ~ ~ twice.

We don't know enough at this point to say definitively whether Menendez is guilty or not, HE could have paid off the prostitute to recant her story.

That being said, that seems unlikely and it's far more plausible that she was paid to make up false claims. If this is the case, Menendez obviously deserves his seat in Congress and if the FBI can find out who paid her off, they deserve time in prison.

I was ready to throw Menendez under the bus before (even though he's a D, that's not the kind of scandal we need in our government), now I'm more than willing to hear his story and try to make sense of this all. I hope he was telling the truth and we can move past this.

that's a fairly misleading statement as most of us have seen plenty in the news regarding Sen. Menendez and this scandal.

Perhaps they're weren't covering it in "full-blown-sound-the-alarms" typical scandal fashion because many questions remained as to how truthful the story was. Given this latest development, it's fair to say that they entire story is not out there and barring further investigations by the appropriate authorities some discretion on this story is/was warranted.

Regarding Herman Cain. Sen. Menendez's scandal involved a single questionable accusation from two women who picked Menendez's picture out of a lineup, one of whom has since recanted her story. Herman Cain's scandal involved 4 separate women around the country, and a phone bill showing dozens of calls/text between Cain and one of the women (some late into the night) that he could not explain other than to call her an "acquaintance". While they are both damaging sex scandals, the former is at least questionable while the latter is far more certain.

        It is a sad comment on our values that a woman who takes money for sex, and apparently also takes money for uttering a false and libelous statement, then recants the statement and admits to lying is considered more credible than an elected member of Congress.

                          So when she was standing in front of the camera and saying she had sex with Menedez how was she being forced to do that?                           Rick, my excellent senator Al Franken graduated from Harvard with a Bachelor of Arts cum laude degree in government in 1973. After that he had a career writing political satire and comedy and later hosted a radio talk show that used satire to expose political misdeeds by both Republicans and Democrats. He wrote carefully researched books exposing right wing media machinations. So I guess I'd argue that his credentials were more than equal to Ronald Reagan's. He's proven to Minnesotans that he's an intelligent thoughtful politician, and has sponsored bipartisan bills that actually passed into law. Over the years of his reporrting and writing on politicians' misdeeds, he's never been proven wrong. You can disagree with his politics, but he's correct on his facts.

                          While I do not agree with a lot of what the Tea Party people stand for, I do respect their right to have a voice. Most of the ones I've meet are regular people who feel government has gotten too big and is intruding in people's lives way too much. Some of their demands are over the top, in my opinion, but they are not the nut jobs most people on the left claim them to be.

                          Personally, I think the left is jealous that this loosely knit group has garnered so much attention and their own group, Occupy Wall Street has proven to be more of a off the beaten path and has kind of disappeared.

                                          Who rewrote the age of the hired prostitute from the age of 23 which was given in the news to 13 ?? Sounds like a fox lie to me a 23 year old is not a minor child but she was a paid whore by the Republicans to lie.

                                          This just gets ridiculous over and over and over and over again!!!!!!!!!!!!! I read about the Republicians and the Democrats that post their views on these stories and it makes me sick. A NATION DIVIDED WILL FALL. Folks I don't know about your household but not only have Americans lost millions of jobs, but those of us middle (LOWER) class citizens who are still working are also in dire troubles. I have not had a raise in over four years and my living expenses have risen to cut into my salary by at least 15-20 percent. All the while our politicians have had the audasity to cater to themselves with their lavish lifestyles on our dime and the favors of big business and big money! Its not just democrats or republicians, its both! You all sit here on these stories and comment, bickering back and forth about who's right or wrong, who did this or that, who is not doing their job---SHUT UP! Our government is so out of control and touch with the true Americans, democrat or republican that these kinds of things are happening all the time not only with the more prominent government figures but down to the workforce that supports the rest of our government. Bernenke not long ago put out an estimated figure of wasted tax-payer monies on programs and projects that have had countless double dipping to the tune of 200-300 BILLION DOLLARS of waste! Until we get off our aligned political party a$$es and start voting out the trash politicians on both sides and voting in Americians who really want to help out our country, we are going to continue to see this sort of thing. Stop bitching at each other and work together to reshape our government to help America and Americans to be strong and prosperous again. Big business, Big government, and greed has deeply rooted itself into our country's wealth and moral values and it is time to take it back. Vote for the right candidate, stop buying from corrupt businesses and start buying from the small guy that has our same values, educate ourselves and spend our money wisely and most of all get with your friends and neighbors to work together and do the right thing for America. IT IS UP TO US!

                                              I can understand, things take a while. First you have to get approval from five agencies, then the president goes out to get the money from China, then the Chinese have to figure out whats in it for them, then the money is sent to the U.S., then it has to be laundered, then finally the check has to clear the bank here, then the prostitute child gets her check, then it has to go through some Dominican bank, a couple kickbacks here and there, then the lawyer makes it all look official, and finally..... see the senator pervert was a good guy after all story.

                                              bigo- you keep talking about this woman being a 13 yo, even in the original story in the daily caller/briebart said she was 23yo, but i guess that wasnt what suited you so you try to make this even more than what it was. and where in this article does it say she was a prostitute kid? your hate of Obama is showing- it doesnt matter to you if Menendez is guilty or not, just gives the far right a reason to go after the President.

                                              kred- i looked at several stories and couldnt find any that said he liked underage, unless of course you have a link. and where in my comment do i call you or anybody a racist? or perhaps your guilt is showing and you know what you are and are afraid others will see it as well? just hate of Pres. Obama and the Dems for whatever the reason. and i dont think Menendez is totally innocent here, but i doubt we will ever know the truth because the right and the left will never believe what the other is saying, and if all he is guilty off is paying a prostitute in another country, who gives a rats azz.

                                              There is STILL that $58,000+ money that he "forgot" about...until he was caught in the audit...THEN he paid it..

                                              That would have NEVER been paid, if he didn't get caught... If this were a Republican, the Obama Administration would be calling for "tar and feather" for him..

Pretty certain the taking the helo to his kids games was a dem storyline to smash christie but instead got flattened itself when the truth came out that christie was on official business and diverted off to see his kid play. No one had a problem with a governor who is expected to travel all over stopping off to see his kid. How many times has air vacation one popped around for the obama kids? Oh, thats different. Not sure about the Republican guy going all over the world to have sex with little boys.... but, I am certain that if you know about it... he's long gone and not being a media darling after the payola went through.                                                   Harry Reid said he believes in Menendez's innocence, and stands beside him. To nominate a man that is being investigated, and to make a statement like that, then watched him cough up 58K stating he forgot, and now to have a prostitute change her story with one of Menendez's friends. Harry Reid needs to get fired right alongwith Menendez's A$$.

                                                  Harry Reid is protecting his base. While the Democrats hold an edge in the Senate, Governor Christie, a Republican, in New Jersey is popular and Harry is worried that should Menendez be forced to resign, there's an even chance that a Republican would be appointed to finish out the term, then possibly, be re-elected in the next general election, thus eroding his base. Harry Reid enjoys being the Senator Majority Leader (who wouldn't) and will say anything to keep that position.

                                                  I don't know Nexis; I don't know Sen Menendez. But knowing life in the Caribbean, politics among Cubans in the U.S. (even found a way to be players in Watergate; albeit the fools that got caught), and the "rising young stars" of the withering past . . . paying to lie about sex is a pretty ordinary political/social occurence. In fact, it shouldn't cost much at all. Nor would it take great effort to find a female player - it's just not that charged with the touchy, feely details we layer on in the U.S. U.S.$$ smooth over a lot.
