Updated at 6:26 p.m. ET: At his confirmation hearing Thursday before the Senate Intelligence Committee John Brennan, President Barack Obama’s nominee to head the Central Intelligence Agency, defended Obama’s policy of targeted killings of terrorists, saying that some Americans had a misimpression that “we take strikes to punish terrorists for past transgressions. Nothing could be further from the truth. We only take such action as a last resort to save lives when there’s no other alternative” to avert a threat to the nation.
Despite the questions about Obama’s use of targeted strikes to kill people whom the administration calls “senior operational leaders” of al-Qaida or affiliated groups, it seemed by the end of the three-and-a-half hour hearing that Brennan was certain to be confirmed. Intelligence Committee Chairman Sen. Dianne Feinstein, D-Calif., called him “a fine and strong leader” and pledged her support for him.
Alluding to some raucous protesters who had interrupted and delayed the hearing, Brennan said, “They really have a misunderstanding of what we do as a government, and the care that we take, and the agony that we go through” to ensure that innocent bystanders or civilians aren’t hit in targeted killings. “People are reacting to a lot of falsehoods that are out there.”

He said, “I think the American people would be quite pleased to know that we’ve been very disciplined and very judicious” and that the Obama administration only uses targeted killings “as a last resort.”
On American citizens who become involved in al-Qaida or allied group abroad, Brennan said, “any American who joins al-Qaida will know full well that they have joined an organization that is at war with the United States” and that the U.S. government “will do everything possible to destroy that enemy to save America lives.” When Sen. Ron Wyden, D-Ore., asked if such a person could surrender before the U.S. government killed them, Brennan said “they have the ability to surrender anytime, anywhere.”
Brennan told Wyden if a person is killed by mistake in a targeted killing, the government should acknowledge it publicly.
In answering another question from Wyden about the public’s understanding of the standards Obama uses to determine if he has enough evidence to order the killing of an American who is involved in al-Qaida terrorist plans, Brennan said, “What we need to do is optimize transparency on these issues and at the same optimize secrecy and the protection of our national security. I don’t think it’s one or the other.” He said, “We need to explain to the American people what are the thresholds for action” and what procedures the CIA and the president use to ensure that the killing are legal.

Thursday’s hearing was a chance for senators on the panel to ask Brennan whether Obama is using drone strikes as a less politically troublesome option than capturing detainees and putting them in Guantanamo.
“I never believe it is better to kill a terrorist than to detain him,” Brennan told Intelligence Committee ranking Republican member Sen. Saxby Chambliss, R-Ga. “We want to detain as many terrorists as possible so we can elicit the intelligence from them in the appropriate manner so that we can disrupt follow-on terrorist attacks.”
But Brennan did not reveal how many high-value al-Qaida suspects had been arrested and interrogated since Obama became president, promising Chambliss only that he’d get that information for him.
In reply, Chambliss said during Obama’s presidency that only one high-value al-Qaida suspect has been arrested and interrogated.
On the targeted killings policy, Obama directed the Department of Justice Wednesday to give the congressional intelligence committees "access to classified Office of Legal Counsel advice” related to the policy. This move came after NBC News on Monday published a Justice Department white paper giving the legal basis for the targeted killings.

The memo said it was lawful for the president to order people who are leaders of al-Qaida or “an associated force” killed when such people pose an imminent threat of attack against the United States and when it isn’t feasible to capture them. This is true even if they happen to be American citizens.
Brennan and other Obama administration officials say that the congressional authorization to use military force enacted after the Sept 11. 2001 attacks provide all the legal authority Obama needs to order the killing of al Qaida terrorists or those plotting attacks on the United States.
Feinstein complained to Brennan that the Justice Department has still not turned over eight Office of Legal Counsel opinions giving legal rationale for the killings. And she complained that only senators on the panel and not their staff members are allowed to read them. “The Justice Department is not yet followed through on the president’s commitment,” added Wyden.
In the opening stage of the hearing senators wanted to ask Brennan, who worked at the CIA for 25 years, about his knowledge of the enhanced interrogation techniques including waterboarding that were used by CIA operatives prior to 2008 to get information from al Qaida detainees.
“I did not take steps to stop the CIA’s use of those techniques. I was not in chain of command of that program,” Brennan told Chambliss.
“I was aware of the program – I was CC’d on some of those documents -- but I had no oversight,” he added. He also said, “I had expressed my personal objections and views to some agency colleagues” about some of the EIT methods such as waterboarding.
Brennan told Chambliss that he had the impression in 2007 that "there was valuable information coming out" from Enhanced Interrogation Techniques, but that after having read parts of a 6,000-page internal CIA review of the EIT program, he now doesn’t know if those techniques did elicit valuable information.

Question#2: What are they using as the definition for: posing an "imminent threat" of an attack against the United States? Question#3: What is their determination for capture operation as "infeasible"? Question#4: Why would we send in a drone into a country that we apparently have good relations with, instead of asking them to assist in the capture of these individuals? Question#5: Who is the individual that is able to make the decision that it is "infeasible" to capture the individual? Question#6: Who has the power to monitor and say that a capture is feasible? Question#7: Are these the same person making these decisions about capture? Question#8: What makes a capture "infeasible" or for someone to be captured? Question#9: Are the people monitoring the feasibility of capture on the ground or satellite observers? Question#10: How can satellite observers make a true decision on the feasibility of capture, since they are not at actual site? Question#11: What makes an operation consistent with applicable law of war principles? Question#12: What does ‘realities’ of the conflict and the weight of the government’s interest in protecting its citizens from an imminent attack actually defined as? Question13 Where do you find the power in the Constitution that would not require the government to provide further process to such a U.S. citizen before using lethal force? "Dead or Alive" is mostly Hollywood fiction. Most wanted posters offered a reward for "capture and conviction". The rare instances where dead or alive posters were put up by the law (as opposed to some private group like a railroad or bank) involved criminals who had already been tried and convicted.

We are not at war with Yemen, they are a sovereign nation that has received much money to allow us to use drones in their country in their[read our] fight against "Terrorists" and has killed some of their citizens in collateral damage. This means to me that we would also have their help in the capture of these targeted US citizens so thst they can have their due process instead of being killed! We must prove that they are in effect traitors! What do you think the people in Yemen think of us violating their sovereignty? I am sure it is not making us any friends! Yet we are doing these drone attacks in Pakistan ,Yemen and Somalia, and the last time I looked we were not at war with any of them! I will repeat that I have no qualms about killing US citizens in the actual attack of us, but am concerned about killing them without proof or due process and only on the assumption that our government is correct, one such assumption that had our troops killed in the War on Iraq was for weapons of mass destruction! @AntiCMatthews, Actually read about this yesterday, but there was a US citizen killed on 11/03/2002 during G.W.Bush era in Yemen by our first drone attack there, his name was Kemal Derwish aka Ahmed Hijazi! I think that was illegal then also! This is a thorny issue to be sure. I support the concept of due process of law. However, when individuals declare war on the US by either word or deed, regardless of their citizenship or current place of residence, they forfeit their right to due process and should expect to bear the consequences of their actions. My preference would be for them to be apprehended and convicted of their crimes in a court of law, but I can foresee circumstances where I would be unwilling to risk American lives to bring this about. I have not had problems with the publicly reported instances in which this policy has been used, but I do worry about a precedent being set and its misuse in he future. A reasonable compromise might be a oversight process whereby a trial of sorts would be required before an individual's name is added to a "kill list". Once a person is on the they could be taken out by a drone, or any other mechanism, whenever the opportunity presents itself.

I have been watching the Brennan hearing blow by blow and I have decided that if I were a Senator with the power to vote an up or down vote, I would vote NO!!! I would not want this man head of the CIA. When a Senator asked him about Drones being used against Americans on American soil he evaded the question only eluding that he will willingly attack Americans on our own soil. Brennan showed more concern for terrorists over there than Americans over here. He was caught by several Senators as being the MAIN leaker causing the death of an important "Asset" over there. This man not only should not be CIA director but should be put on trial for causing the death of someone helping the CIA. Apples to Oranges. Hijazi was NOT the target and there is no evidence that the US even knew he was in the car. Collateral damage is not the same thing as deliberately targeting an American citizen for assassination.
The Constitution is dead. Natural rights are not and were never subject to citizenship, let alone what country you happen to be in. This will inevitably be used to kill political dissidents vacationing abroad/visting relatives overseas who have no actual connection to terrorists. And it will inevitably, even if secretly at first, used to kill political dissidents here at home too.
As someone who is libertarian and travels abroad to many nations for work (I play poker for a living, and have for better than 5 years now), I have a great fear that I will find myself on some list (if I'm not already). My political and philosophical opinions are not mainstream (albeit completely nonviolent except in direct self defense). But history has shown people like me get rounded up and killed when the ship of state goes down.

Even the general is sceptical of our legal system. Gen. Michael Hayden said “interrogating al Qaida operatives is a vital source of insight into the terrorists’ plans. But he warned, “We have made it so legally difficult and so politically dangerous to capture that it seems, from the outside looking in, that the default option is to take the terrorists off the battlefield in another sort of way” – in other words, by killing them.”

I watched this whole Brennan hearing all afternoon. I thought he was very evasive in areas he should not have been (not for the sake of necessary secrets). One senator questioned him as to whether or not he was pure CIA or just Obama's political lapdog. Another senator in an interview afterward wonders also if he is just Obama's lapdog. The Department of Homeland Security is set to purchase a further 21.6 million rounds of ammunition to add to the 1.6 billion bullets it has already obtained over the course of the last 10 months alone, figures which have stoked concerns that the federal agency is preparing for civil unrest.
A solicitation posted yesterday on the Fed Bid website details how the bullets are required for the DHS Federal Law Enforcement Training Center in Artesia, New Mexico.
The solicitation asks for 10 million pistol cartridge .40 caliber 165 Grain, jacketed Hollow point bullets (100 quantities of 100,000 rounds) and 10 million 9mm 115 grain jacketed hollow point bullets (100 quantities of 100,000 rounds).
The document also lists a requirement for 1.6 million pistol cartridge 9mm ball bullets (40 quantities of 40,000 rounds).
An approximation of how many rounds of ammunition the DHS has now secured over the last 10 months stands at around 1.625 billion. In March 2012, ATK announced that they had agreed to provide the DHS with a maximum of 450 million bullets over four years, a story that prompted questions about why the feds were buying ammunition in such large quantities. In September last year, the federal agency purchased a further 200 million bullets.
To put that in perspective, during the height of active battle operations in Iraq, US soldiers used 5.5 million rounds of ammunition a month. Extrapolating the figures, the DHS has purchased enough bullets over the last 10 months to wage a full scale war for almost 30 years.
Such massive quantities of ammo purchases have stoked fears that the agency is preparing for some kind of domestic unrest. In 2011, Department of Homeland Security chief Janet Napolitano directed Immigration and Customs Enforcement to prepare for a mass influx of immigrants into the United States, calling for the plan to deal with the "shelter" and "processing" of large numbers of people.
The federal agency's primary concern is now centered around thwarting "homegrown terrorism," but information produced and used by the DHS to train its personnel routinely equates conservative political ideology with domestic extremism.
A study funded by the Department of Homeland Security that was leaked last year characterizes Americans who are "suspicious of centralized federal authority," and "reverent of individual liberty" as "extreme right-wing" terrorists.
In August 2012, the DHS censored information relating to the amount of bullets purchased by the federal agency on behalf of Immigration & Customs Enforcement, citing an "unusual and compelling urgency" to acquire the bullets, noting that there is a shortage of bullets which is threatening a situation that could cause "substantial safety issues for the government" should law enforcement officials not be adequately armed.
As we highlighted last month, the DHS' previous ammunition solicitation was awarded to Evian Group, an organization that was formed just five days before the announcement of the solicitation and appeared to be little more than a front organization since it didn't have a genuine physical address, a website, or even a phone number.
While Americans are being browbeaten with rhetoric about the necessity to give up semi-automatic firearms in the name of preventing school shootings, the federal government is arming itself to the teeth with both ammunition and guns. Last September, the DHS purchased no less than 7,000 fully automatic assault rifles, labeling them "Personal Defense Weapons."

There are numerous countries in the world, Theocracies, as they are known, who's concepts of trial rights and natural rights are distinct from the interpretation of secular democracies. Define what you mean by trial rights and natural rights, and remember our (US) laws function within the confines of our boarders and territories, but are not universal around the world. The Obama administration’s recently-leaked “white paper” on the assassination of US citizens, and the actions carried out on the basis of the arguments it advances, must be taken as a dire warning to the working class in the United States and around the world. The democratic rights of the people are in grave peril. The American ruling class, steeped in lawlessness and violence, is moving toward dictatorship.
The administration’s frontal assault on democratic rights and constitutional protections—asserting the “right” of the president to unilaterally and secretly order the state murder of American citizens—is undeniably grounds for impeachment. The crimes of Richard Nixon, who nearly 40 years ago resigned the presidency rather than face impeachment and removal from office, pale in comparison to Obama’s assertion of unconstrained executive powers.
The pseudo-legal arguments of the Justice Department memo, recalling the Bush administration’s infamous torture memoranda, boil down to the following:
The president and the military-intelligence apparatus, based solely on their own internal deliberations, have the power to assassinate any US citizen who they decide is a leading member of Al Qaeda or its “associated forces.” This power has no geographic boundaries. Nor can it be limited by any form of congressional or judicial oversight. The White House and its military/intelligence advisers are judge, jury and executioner.
The entire document is an exercise in doubletalk and sophistry. While it asserts, for example, that those selected for elimination have to pose an “imminent threat of violent attack,” it proceeds to define “imminent” to mean its opposite. The government needs no proof that any specific action is planned or that something is to take place in the immediate future.
In the end, nothing remains of core democratic rights. The principle of due process—with roots going back to the 13th Century and enshrined in the Fifth Amendment to the US Constitution’s assertion that no individual can be “deprived of life, liberty, or property, without due process of law”—is dispensed with.
The justifications for this assertion of dictatorial powers—national security and the requirements of war (in this case, the global “war on terror”)—are the same as those invoked by every military and fascist regime, from Hitler to Pinochet.
Yet these developments have provoked no significant opposition from within the political or media establishment.
The response of the New York Times, the main newspaper of American liberalism, is particularly significant. In an editorial published Wednesday, the Times regrets the undisguised character of the administration’s contempt for constitutional restraints and proposes measures to give the killing operation, including of American citizens, a legalistic gloss. It suggests the creation of a “special [i.e., secret] court to handle this sort of sensitive discussion, like the one it created to review wiretapping.” In other words, a star chamber to rubber-stamp state murders in similar fashion as the secret FISA court sanctions unlimited domestic spying.
The Times does not call for a halt to program of extra-judicial assassinations, nor does it suggest that Obama and his accomplices be held to account…

The question of drones are just part of Brennen's interview. One republican wants to hold up his nomination until he answers questions about his salary from a private company. A question Never asked of any nominee before. No one ever asked Don Rumsfeld about his link to supplying parts to North Korea to make nukes and how much he made from it. Do we need more over-site on targeting US citizens, yes we do. Should we allow the targeting of US citizens who take up arms or plot the killing of US citizens, yes we should. In reality it's no different than any of us killing a person threatening a member of your family. Your argument seeks to cover ground The Founders have already rejected. They did not control foreign governments. They did not want them controlling ours. They never thought of giving back any of their hard won freedoms, but were open to expanding on them when just cause dictated that such be done.

The Declaration of Independence is different from the Constitution in that the colonies rebelled against the monarchy... the monarchy deriving it's rights directly from God through inheritance ( linage ). Of course one must plow through English history back through time to 1066, Cromwell and etc, the establishment of Parliament, but the claims of Monarchs is their powers are derived through "powers" other than secular republic style of authorship as the US has. The US Constitution establishes state's rights, individual rights, and the court system to interpret those rights, and when one swears to uphold the Constitution, one does so to protect it from enemies, " both foreign and domestic ". 1) There were drones on station over Benghazi, ASAP after the W.H. was alerted. The interesting part is...they werent armed. The even more interesting thing is, in the time it takes to get a sub-sonic drone on station, you could get a sorti of supersonic fighters on station, armed for CAS.
2) In order to know an American attacker was near the embassy would imply prior knowledge of the attack and prior information on the attacker. If you had that prior knowledge, those intel sources could go to court and have him convicted of treason well before an attack.
3) The requirements to kill an America by indicting him and then going to court all go out the window when he/she starts attacking an embassy, because lethal force then becomes an option anyway. Just as lethal force is legal against American citizens, in the United States, actively attacking someone.
4) Number three becomes especially irrelevent when you consider we had no idea (assumption) who the people attacking our embassy were...and it doesnt matter as lethal force was authorized anyway.
