Updated at 4:50 pm ET In a split decision, the Supreme Court on Monday upheld one part of a tough Arizona immigration law, but struck down other sections.
The Supreme Court has handed down a ruling on Arizona's strict immigration law. NBC's Pete Williams reports.
The part of the law the justices upheld requires police officers stopping someone to make efforts to verify the person’s immigration status with the federal government.
The justices struck down three other parts of the law:
- One making it a crime for an illegal immigrant to work or to seek work in Arizona;
- One which authorized state and local officers to arrest people without a warrant if the officers have probable cause to believe a person is an illegal immigrant;
- And one that made it a state requirement for immigrants to register with the federal government.
"Arizona may have understandable frustrations with the problems caused by illegal immigration" while the federal government tries to enforce immigration law, but the state "may not pursue policies that undermine federal law," wrote Justice Anthony Kennedy in the majority opinion.

The U.S Supreme Court annoucines decisions on June 25.
The court said that there are several ways for state officials to cooperate with the federal government on immigration enforcement, such as by responding to federal requests for information about when a particular non-citizen will be released from state custody.
"But the unilateral state action" to arrest and detain suspected illegal immigrants "goes far beyond these measures, defeating any need for real cooperation" between the state and the federal government.
Monday's decision is only a prelude to further litgation over what now remains of the Arionza statute.

NBC’s Pete Williams reported that “there are other lawsuits against this law. There are several civil liberties groups suing in Arizona, claiming that this law is racial profiling, and those cases have yet to work their way through the courts.”
Monday's decision was a partial victory for President Obama who had criticized the Arizona law, saying it “threatened to undermine basic notions of fairness that we cherish as Americans.”
Republican presidential hopeful Mitt Romney said Monday, "I would have preferred to see the Supreme Court give more latitude to the states not less. And there are states now under this decision have less authority, less latitude to enforce immigration laws."
He added that immigration policy has "become a muddle. But it didn’t have to be this way. The president promised in his campaign that in his first year he would take on immigration ... put in place a long term program to care for those who want to come here legally, to deal with illegal immigration, to deal with securing our borders. All these things he was going to in his first year he had a Democrat house and a Democrat senate but he didn’t do it. And because he didn’t act, states and localities have tried to act and now the courts trying to get into it and sort things out and it’s a muddle"
Attorney General Eric Holder said in a statement that "I remain concerned about the impact" of the part of the law that requires police to attempt to check the immigration status of people they stop when they have reason to suspect that the person is in the United States unlawfully.
Holder said the Justice Department "will continue to vigorously enforce federal prohibitions against racial and ethnic discrimination. We will closely monitor the impact of S.B. 1070 to ensure compliance with federal immigration law and with applicable civil rights laws, including ensuring that law enforcement agencies and others do not implement the law in a manner that has the purpose or effect of discriminating against the Latino or any other community."
House Judiciary Committee Chairman Lamar Smith, R-Texas, said flatly that Monday's ruling was a defeat for those who seek stricter enforcement of immigration laws.
Smith said the decision "limits the ability of states to protect their citizens and communities from illegal immigrants. It is the federal government’s job to enforce our immigration laws, but President Obama has willfully neglected this responsibility. This dereliction of duty has left states to address the crime, job loss, and other costs of illegal immigration."
He added, “Unfortunately, under this Administration, today’s ruling essentially puts an end to immigration enforcement since the states no longer can step in and fill the void created by the Obama administration."
The Justice Department had moved quickly in 2010 to block enforcement of the law. The administration had argued that the Constitution vests exclusive authority over immigration matters with the federal government, not the states, and that where the federal government has pre-empted state action, no state can intrude on that federal turf.
The majority on Monday essentially agreed with that argument.
In the oral argument before the high court on April 25, Solicitor General Donald Verrilli said Arizona did not have the power to exclude or remove a person who is in the state illegally.
Although some critics of the law have contended that it would inevitably lead to targeting of Latinos simply because of appearance, speaking Spanish, or having a Spanish accent, Verrilli told the justices on April 25 “We're not making any allegation about racial or ethnic profiling in the case.”
Since enforcement of the law had been blocked by a federal judge soon after its enactment, the Obama administration did not present a record to the Supreme Court of the law leading to incidents of ethnic profiling of Latinos in the state.
Joining Kennedy's majority opinion were Chief Justice John Roberts and Justices Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor.
Justices Antonin Scalia, Clarence Thomas and Samuel Alito concurred in part and dissented in part.
Justice Elena Kagan, who served as Obama’s solicitor general, had recused herself from the Arizona case.
The high court’s decision comes just days after Obama announced a new administration policy of not deporting illegal immigrants under age 30 who came to the United States, or were brought to the United States before reaching age 16, who are in school, or have graduated from high school, gotten a general education certificate, or are military veterans. The illegal immigrants covered by the new administration policy will be permitted to apply for authorization to work legally in the United States.

But I'll spare you the trouble. It's basically the parts that everyone had an issue with, that is the police being able to stop and arrest people suspected of being here illegally. According to the ruling:
And they go on to say that it is not within the rights of a state (and state law enforcement) to perform the duties of federal immigration officials, namely the arrest and detention of persons thought to be here illegally.
Long story short, as was the case before Arizona tried to make new laws, local law enforcement has no authority or jurisdiction to question someone about their immigration status and even if they learned about their immigration status, they don't exactly have the right to arrest and detain them only based on said immigration status.

The country is going through a recession/depression with millions getting government assistance to stay afloat. The poverty levels have increased 41% and record numbers of people are getting food stamps. If you are grateful for the 'Huge Win' for the Federal Government, perhaps you should be willing to pay for the 'new poor' which the Federal Government is helping to create.

Borders - Are being enforced. As with all things it's not 100%. Some slip through. President Obama has the highest deportation record than the past presidents.

Well, according to the Supreme Court, Arizona doesn't get to decide who is here legally or illegally. This basically pokes a thumb in the eye to anyone who wants to make illegal immigration a crime. Some people are on here talking about how the major parts of the law are still in place. That is simply not true. The most threatening part of the law, which said that officers can arrest people who they THINK are here illegally, is struck down. Does blonde hair, and fair skin make you think someone is here illegally, or tan skin, and an accent? Brewer, and her congressional partners are a bunch of racist pigs, and the racist parts of this law were struck down accordingly.
Apparently, the obvious eludes you. If the major health insurance companies are voluntarily willing to operate within the parameters of ObamaCare, then there really isn't much need for ObamaCare itself.
As I've said all along, Democrats did NOT have to include the individual mandate to legislate regulatory reform for health insurance (mind you, I said health insurance...not health care). Any or all of the "reforms" could have been legislated without making buying a consumer product brought to the market by private, for-profit corporations a condition of being an American citizen in good standing. The individual mandate is nothing more than a gracious thank you to the health insurance lobbyists et al for their campaign contributions to Congresspersons and the President.
If the companies would voluntarily comply with the reforms without the individual mandate, why is it necessary to enslave every American to one corporation or another so they remain profitable to the tune of hundreds of billions of dollars...?

In my state the police are required to check for auto insurance every time they pull someone over.
If that's unconstitutional, fine, but if it's not, I don't see how checking immigration status would be.
Actually the police can only verify citizenship if the person is in custody, traffic stops wont work. And think about it this way, put yourself in the shoes of an American born in this country but with Mexican desent. So you pretty much look mexican but are an American, how would you feel if you got stopped and asked to prove you belong here? Any time a US citizen is pulled over for a traffic violation a check is run to see if there are any warrants. Why would we exclude checking if someone is a legal citizen? Illegal citizens can not get a Driver License unless they are using someone else's social security number. SO often officers pull these people over, give them a ticket for driving with a license and fail to investigate further if the person is legal or not. SO often these violators go to court in front of a Judge and they simply pay the fine for driving without a license. Why are these law breakers allowed to go free after they pay a fine? Why are they not deported?

The libs seen to be having a Field day on SB1070. However the court struck down 3 provisions because state law can not supersede Federal law. There are already Federal laws that cover these provisions. They refused to rule on the biggest and key provision of the law.

In my state it is not illegal for a immigrant (illegal or legal) to get a driver's license.
The only part of the law that remains intact is the ability to ask about legal status when someone is arrested. Unfortunately the presence of someone in the country without being properly documented is not illegal in this case. At most the person can be issued a summons to appear before a group which determines their fate (deportation, asylum, etc.). In this regard the police are still not going to be able to deport folks from this law. It has essentially been gutted.

OK, so the Court implies in their ruling that to act with the intent of enforcement of a law that says it is illegal to be in the US illegally is illegal because it infringes on the legal rights of people in the US. OK, so I am hearing it is illegal to enforce a law that would allow us to check and arrest someone who is here illegally because it infringes on their rights? Basically the SCOTUS upheld Arizona's right to check for immigration status and told the Federal government (despite Obama's recent statement) that it has to uphold its own laws. Big win for Arizona and the US.

Let's give the facts a go:
1.) Striking down parts of the Arizona law does not mean those things are then legal. Those parts were struck down because they would supercede federal laws which are already in place.

3.) We have no national language. In part, because this entire nation was built on diversity and immigrants. Did you know, for example, that the New Mexico state constitution is in both Spanish and English? That's because New Mexico was originally part of Mexico and a large portion of those living there (at the time it was made part of the U.S.) were Latino. There's no reason to make a national language. There are many countries that have large portions of individuals who speak many different languages and they get along just fine. How about you learn another language and make yourself a bit more worldly?
Also, for the poster above who tried to claim that making a national language is to benefit immigrants because they are at a disadvantage -- if your real concern was helping immigrants, then shouldn't you be arguing for more money to be put toward ESL classes or something similiar? That would be more useful than trying to make a national language.

Roland, Actually the term Americans does belong to just the United States. Americans are the citizens of the United States of America. The country is home to people of different national origins. As a result, Americans do not equate their nationality with ethnicity, but with citizenship. People from Mexico refer to themselves as Mexican and People from Canada refer to themselves as Canadian. True, they are both North American, but they aren't American.
If You look at the ruling it is entirely logical, the Justices upheld the States right to stop someone they believe is a criminal, the three parts that were stricken down were parts that already exist in Federal Law and are the responsibility of the Federal Government to uphold. The Justices probably believe that future Administrations will be more competent and actually uphold the laws They swear an Oath to uphold , therefore there is no need to re-inforce existing law.

Illegal immigrants (from the south... I can't imagine anyone that would want to move to the US from Canada) take the jobs that many Americans don't want to take... Before the company that I used to work for did a big crackdown on illega immigrants, we had a very efficient kitchen. They worked harder than I've ever seen any person of any race work (I'm Caucasian, FWIW), they didn't complain about their jobs or their pay, and they knew enough English to get by. Once our company cracked down and they were all fired, we had to rehire, and the only applicants we had were a bunch of 16 year olds whose parents were forcing them to get jobs. They had no work ethic, and our kitchen suddenly had a revolving door of new applicants in and failed employees out. Nobody could even begin to grasp the amount of work that our "illegal immigrants" had done. I ended up leaving a year later, frustrated with the sudden 200% turnover rate that we had because we couldn't get people to work at a pace that would allow our restaurant to be profitable. If illegal immigrants are willing to do the job, let them have them, because the spoiled children of today can't handle them, and no adult can make a reasonable living doing it (and Big Fat America has forgotten how to cook at home).

What the SCOTUS has done is given AZ a way to actually measure the federal gov't response to illegal immigration...since AZ can now ascertain the immigration status of arrestees and then document that those illegals were brought to the attention of the federal immigration authorities. This will result in quantifiable data that can sway elections, both state and federal. Basically, the SCOTUS has put the Obama Adminstration on notice that it can't just turn a blind eye to illegals committing crimes without taking action.

The court did what the court should have done in striking down the majority of this law as pre-empting what is the federal government's constitutional right. Its amazing how all the strict constructionists can't get past this. One only has to read Justice Scalia's convoluted dissenting opinion to understand the lengths that this "Activist Conservative" court to impose their agenda. The more important case was the stiking down of the Montana good government statute, that's the real threat to our democracy, non-transparent, unlimited spending to sway our elections. I wouldn't mind the spending so much if I knew exactly who was behind it so we could judge for ourselves what self-interest they are working for.
The court did make the right decision. If you read and understand the law and your Constitution this is the only decision that could be made. That said, it still doesn't solve the issues that many of the States are facing from illegal immigration. The Federal Government is not enforcing the laws that are in place. Therefore if I were these states and someone was picked up and found to be an illegal immigrant, I would take and drop them on the White House Lawn and/or Congress chambers. Let them deal with it face to face.

I wouldnt be too sure, I just watched a clip from news online about a month or so ago where they were talking about the trust worthiness of voting. If i recall it showed how easy it was for people to vote with improper ID or being able to vote when they shouldnt. It really affects the integrity of votes. I will have to find it.

Illegal aliens now quite possibly can call a toll free government number, 1-800-259-0957, to get a free “Obama Phone.” The program, conventionally known as Safe Link Wireless, is available to those are on food stamps or Medicaid. Applying for work permits that give them drivers’ licenses provides illegals proof of identity. With that, they enter America’s entitlement class and even become enabled to vote in our elections — for Democrats, of course.
The Obama administration has set up a cascading series events, beginning back in August when deportation of tens of thousands of illegal immigrants was suspended, pending reviews. “A review of about 300,000 deportation cases currently before the immigration courts,” will be done by the DOJ and Homeland Security to “halt deportations of longtime residents with clean police records who came here illegally when they were children,” according to a New York Timesarticle.
A source contacted me saying she translated Latino publications, and they are urging Hispanic illegals to be sure to get their work permits, so they can get drivers’ licenses, so they can register to vote. In the Chicago way, are we seeing the Obama campaign begin now to pad their Democrat voter lists by providing illegals incentives to vote for Obama by paving the way to sidestep those onerous voter ID rules about 35 states have enacted?
Democrats Benefit From Illegal Immigrant Voting
Why are Democrats so uniformly opposed to proof of citizenship in order to vote? They and their interest group surrogates insist there is no problem with voter security. But why should we believe this when we know illegal immigrants routinely lie to obtain employment? (Federal law requires employees to sign a document called an I-9 Form upon becoming employed swearing under penalty of perjury that he or she is authorized for employment, i.e., is a citizen or lawfully admitted alien and to provide two forms of ID to prove it.) I have seen thousands of bogus I-9 Forms signed by illegal immigrants and copies of their false social security cards in my RICO cases against employers who hire them. These false attestations are rarely prosecuted by federal authorities. And why would we think illegal immigrants, whose very presence in this country is a crime, would be above a little more crime in order to obtain employment?
Once that is understood, why would we think illegal immigrants would not also lie to obtain medical care in public hospitals, food stamps, unemployment benefits, and register to vote? Only two states actually require proof of citizenship in order to register (Arizona and Kansas). The others merely require the applicant sign a sworn statement attesting to the fact that he or she is a citizen. But this is what is asked, and routinely perjured, on the I-9 Form. Thus, it follows that false claims of citizenship in order to register to vote should be widespread. There are some media reports of non-citizens voting, but generally, the media have not investigated the problem in any depth compared to their obsession with the insurmountable problem Republicans will have with Hispanic "voters."
The perceived trouble Republicans face, we are constantly told, stems from the party's opposition to illegal immigration. And perhaps there is a kernel of truth to this theory. It stands to reason that illegal immigrants who are illegally registered to vote would have a very real stake in seeing to it that Republicans do not come to power with their far right ideas about requiring proof of citizenship to vote (which has been required since the founding of the Republic) and to be employed in this country. After all, if these laws were seriously enforced, it might be intolerable for illegal immigrants to live in the U.S. They would, presumably, lose employment, subsidized medical care, and the right to vote for candidates for will perpetuate such a way of life.
Democratic party spokesmen justify their opposition to laws requiring proof of citizenship in order to register to vote by the absurd claim that poor people do not have birth certificates or passports. But we require everyone, including the poor, to produce such documents when becoming employed for their I-9 Forms. And if that is tolerable, then it must also be tolerable for the same documents to be produced to register to vote and some sort of photo ID in order to vote.
There is a huge problem with voter fraud. And, in my opinion, it is proven by the vehemence of the Democrats, the beneficiaries of the fraud, toward enforcement of our laws.

John Lewis (D-GA), let it be known that he equates voter ID laws, or proof of citizenship laws, with Jim Crow laws that if passed will cause America to “step backward toward another dark time in our history.” Lewis also alleged that he did not know of any cases of illegal immigrants voting and it’s a “lot of say-and-do about nothing.”
At the same meeting, Rep, Emmanuel Cleaver II ((D-Mo.) said there are no illegal immigrants voting the U.S. He also said that only 13 cases of voter fraud took place in the entire United States in the past ten years. We’re not sure where Cleaver got his “facts,” but we are positive he and his staffers never bothered to double-check.
According to a report issued by the Commission on Federal Election Reform in 2005, federal prosecutors charged 89 individuals and convicted 53 for election-fraud offenses. Another highlight from the report – In 2004, at least 35 foreign citizens applied for and received voter cards in just ONE county in Texas. That same year, the Washington State gubernatorial election was decided by 133 votes while 1,678 illegal votes were cast. The election was upheld because there was no way to determine which candidate received the illegal votes.
Currently, 29 states have no ID requirement to vote and 31 require some form of identification to vote, with eight requiring photo ID.

No, federal law already required that immigrants carry ID! The Arizona law made it so that cops were, not only allowed, but required to detain and ask for ID from anyone who was brown, er I mean hispanic, er I mean a possible suspect of illegal immigration. Being a "suspect" was made an initial offense. It was very racist and very illegal for that Arizona hag to support this.

Why is this so difficult?!! It was already a federal crime to not carry your papers. Making it a primary offense at the state level was unconstitutional (along with opening the door for harassment and unlawful dentition). Requiring the state police to pull people over or otherwise detain them if they suspected them of being illegal was messed up. Checking their status as a secondary offense is still fine. The state just has no jurisdiction to create and enforce an existing federal law. Now, don't tell me you now want the Fed's checking spending money on a special force to check "suspects" papers....That's a bit fascist in every sense.

Members of Congress live very well off the backs of taxpayers, and for what? They do a pathetic job at best of enacting good laws that are not laden with political favors or written for special interest groups. The laws they do enact are very selectively enforced, which is the reason Arizona made the move they did. Immigration has long been a problem, and a promise from one administration after another. I'm not talking about farm jobs, the high majority of Americans are too damn lazy to do that work (even though I did it as a teenager). But what about construction, restaurants, yard work, painting, warehouse work, house keeping, etc? Don't say Americans won't do that work, because I personally know many that do and would if the jobs were available. My wife worked cleaning a hotel for over a year while she was looking for a job in the medical field, she worked with four illegals. That's four jobs that could've been filled by Americans, pulling them off the government tit.
I also guess it doesn't matter the whole rest of the problem with education, public safety, medical fraud, identity theft, and the whole host of other issues they bring.

I believe two of the current justicees were nominated by Hussein Obama and don't think for a second that just because the three Branch's of government don't have to answer to each, doesn't mean they don't.
The mistake Arizona made was writing a law that made way too much sense. The Federal Gov and Obama could never support anything like that.
The law needed to say something like: "If you suspect somebody of being an illegal immigrant then you should throw them a parade, hand them jobs, and pay for their welfare, education, and healthcare". This is about the only law that Obama is going to support regarding illegal immigrants.

I think, in regards to your "conservatives say 'get a job'" remark, that the primary issue most conservatives have with non-workers is the 100% dependence on government aid programs for which they pay nothing into, and those that do work and pay taxes are supporting. That part will be litigated again. Since the justice dept. blocked the law, that provision did not see much application. As soon as the police start trying to apply it in AZ we will see a slew of Civil cases that this is being applied as racial profiling. This is by far not the last word on the Papers Please portion of the law, and because the other provisions have been struck, if police can not quickly determine someone is here illegally they will have to let them go on their way.
What you will have is more crimes being committed against illegals in the country because they are unable to contact the police who have tried to avoid looking into immigrant status to gain cooperation with illegals in solving crimes. Sorry, but that's the reality. They are here, and they will just be driven deeper into hiding.

I would like to suggest that they cure that by leaving the USA.
I am a conservative but I am okay with this ruling. The provision that was upheld says the state can require police officers to verify the immigration status of people they stop/arrest. This, to me, is the "heart" of the bill. So while many parts were discarded, at the core the SCOTUS did find that the state CAN require police to follow up on the immigration status of criminals. This is common sense and I am glad it survived.

@JoeNY, to be fair, the parts of the law that were struck down, are already covered by Federal Laws.
For the remaining points:
If an illegal is in the country looking for work, Federal law already requires reporting them to immigration officials. It is their responsibility to arrest and deport illegals.
The requirement for police to have Probably Cause is a fundamental right in this country. The police do not have the right to harass and detain based solely on the color of your skin.
As for the requirement for immigrants to register (the ones in this country legally), the state law was redundant, since legal immigrants are ALREADY registered with the federal government. This part of the law was, in reality, an attempt by state legislators to create an excuse to round up all non-Caucasians in the state.

Bilingual is restricted only to those who do not speak English so you can't use that class to balance class sizes for the other kids.

Rather we have two languages that a high percentage of citizens read and/or speak: English and Spanish. So, it is not unusual to have a sign in Spanish advertising a Democratic candidate (or whatever it was doing) as I know some US Citizens who speak and read English well enough but their first language is Spanish.

So it's a mixed bag. A police officer still must ask about the immigration status of suspected illegal immigrants, but cannot arrest them.
So what if the suspect says they ARE an illegal immigrant - what then? By the way - If the police pull over a driver who does not have a license (legal status required), then they CAN be arrested for that.
And it's legal for illegal immigrants to seek work, but it's not legal for anyone to hire them.
This ruling is 'clear as mud', and perhaps raises more questions than it answers.

The Illegals situation is by far not over. We have a problem as Americans. Our Immigration and Naturalization Service (INS) is severly underfunded for the mission they are responsible for. In the case for USA vs Illegals, it is not about their contributions to our economics, it is much more about what happens when they are not contributing anymore. Face it - there are leaches on both sides of this. The rich who could give not a single thought to how much they take and how little they actually give and the ones on the bottom with the same philosophy. This is much less an issue of race and more an issue of "LAZZINESS". If you want the drain to stop sucking it out of you - then you need to get agressive with your politicians and put the pressure where it needs to be. The more people who respond in writing to the elected officials - the greater your chances for getting changes in place that actually mean something. Capitalism is structured as, the "most efficient" will be the "most successful". Remove the outsourcing to other countries for the "Lower wage costs" and your products become more expensive and have less value.
The whole point that I am making is - it really does not matter if they are illegal or not - our leadership and businesses in this country are only focused on the bottom line and while they can hire "LOW WAGE" they will do it - with anyone they can - internal illegals or overseas - either way - you don't have a job at a decent wage to live on. There should be laws to prevent this - there are in fact some laws - but the loop holes that are in our legal system allow enough flexibility to result in a permanent employment black hole that will eventually collapse our economy and make us no better than a third world country. There are no other countries world wide that allow such rediculous employment considerations as we do with our businesses who will farm out 100's of thousands of positions to their favorite low wage source in foreign countries. Many of these decisions are because of the "relations" that exist between the business and the countries where some of their decision makers came from. If you want proof of this - just take a look at the statistics - where a company has a high number of Indian's working for them - they hire in India for their labor force - often in mass and amoung relatives. The same practice is applied for many of the other countries - in some way - there is a cultural connection for why they choose the countries they have outsourced to.
For those of you who are dumb enough to believe that "BUY AMERICAN" means you are actually getting an American Made product - get your books out and take a look at what we produce. The majority of our raw materials no longer come from "INTERNAL" sources. The refined products are imported from foreign sources and maybe assembled here - but they were originally "MADE" in a foreign country. The only real products made in America are our food supplies (most of them anyways) and lumber. Both of which are experiencing ever tightening regulation so that the sources are being pulled from foreign soil.
Read the decision. What they said is that as written, with its limitations, that part is not inherently unconstitutional, but it also says that it is all a matter of just how it is implemented, leaving the door open for further challenges.
They did not uphold "Papers, Please". Within the decision, multiple times it makes it perfect clear that immigration is none of the State's business. It makes it crystal clear that the Federal government is the sole authority in deciding what to do about it. It makes it clear that being an illegal immigrant is not a criminal matter, but a civil one under the authority of the Federal government. It makes it clear that States may not interfere, supersede or in any way attempt to pre-empt Federal authority in the matter.
This "upholding" of this provision is essentially a pass on ruling. The law although specific about not profiling and having "just cause", is still vague about how it could be interpreted and implemented. The Court essentially warned that there is not room for broad interpretation and made it clear that there was plenty of room for individual challenges based on how it was implemented. If you read it carefully and in total, basically what it says is that the language of the law isn't unconstitutional in itself, but pretty much warns that in the course of implementing it, it most likely will be. If for example, someone is arrested on a criminal felony, they can and should contact the Federal government about immigration status if there is reasonable suspicion that they may be illegal. Of course that reasonable suspicion can not simply be that they look Mexican. But likewise, if someone is detained on some minor infraction and they are kept in detention for a check with ICE, they may very well be over reaching their authority. Additionally, someone may not be stopped, detained or arrested simply on the suspicion that they might be illegal. Bottom line is that as written, the law was worded carefully to avoid crossing the line. However, to implement the law without crossing the line will be extremely difficult.
I will also note that it doesn't give the State the authority to decide what to do with someone found to be illegal, ICE can very simply say to release them on their own recognisance and the State can not challenge that authority.
Counter to what Governor Brewer stated in her press release, the ruling does not in any way shape or form support State's rights on the matter of immigration and in fact does just the opposite. It makes it 100% clear that the State has no authority in the matter other than what is specifically granted to them by Federal policy.

My coworker's mother passed eVerify at work--actually multiple times, for several different employers. Was deported as an 'illegal' in December anyway--because Immigration never told her adoptive parents in 1945 that citizenship was not automatic with adoption.
No system is entirely foolproof.
Arizona has another option. They are allowed to withdraw business licenses to do business in the state of Arizona if the business is found to be hiring illegals.
If they started just auditing and checking, and actually closing them down for a month--that would do it, or canceling the license and making business start all over from scratch, unable to operate until re-licensed.
It wouldn't take very many sacrificial businesses to go down before the rest of the employers wised up and made good on ensuring only valid citizens are working.

Quit putting your own spin on it peeps - 3/4 was struck down, with the remaining 1/4 - not, btw, the "check your papers" provision, but the check a suspected illegal's status during a routine stop provision - to be further reviewed by a lower court.

In my NE town, our little newspaper never has a police report with lesst han two or three drivers with suspended licenses, no car registration and no insurance, who have been pulled over driving on the highways and in town. Where do you live? I live in Houston, and know full well how they affect us. Most of these illegal immigrants are using someone else's social security number to seem legitimate to the employers. The employers can't question it if the social security number comes valid. I hope that none of them are using yours! Now, if they don't have a social security number they STOLE, they will find employers willing to pay them "under the table", giving them cash. This is what people are talking about how they don't pay taxes. You can find them around 6 am, waiting at gas stations, asking people if they need work done for cash, usually in the construction business. While the businesses may not be able to put this in their own taxes for the business, it is beneficial to the business still, because they are paying them considerably less than they would an American citizen, and that's exactly why the companies do this. The illegal immigrant knows that this is a risk for the company, so they don't demand higher pay.
Welfare-
Using stolen SS# or having kids that were born here, and those kids are having kids to get welfare to help support the whole family. It's amazing how many mexican girls with illegal parents are popping out MULTIPLE children, and are on welfare. It is a scam. I've seen it when I was in high school. This isn't isolated to illegal immigrants, either. Citizens can pop out babies to receive welfare, too, but from what I have personally seen, it's mostly the mexican girls who do and ADMIT to this. Welfare needs some serious reform.

Making it a requirement to register is actually already a federal law and has been for over 70 years. SO for the Supreme Court to say that was unconstitutional is a blatant error on their part as it is already in the constitution.
The only thing that the portion which was intact will do is allow a narrow margin of cops to check and detain. It is not giving them the power to charge you with anything. ICE will still be contacted. ICE will still just let them go.
Had the Supreme court allowed the other 2 provisions too, then AZ would have been able to charge illegals with a crime, meaning they get to hang on and prosecute them. The justices were very careful not to empower AZ to do so.
What they are still trying to prevent are states enforcing these federal laws at their own discretion. The bottom line is still the fact that if the Feds would do their jobs, no one else would feel the need to try and do it for them!
IMHO it should also be seen as unconstitutional for an administration to enforce constitutional laws at it's discretion. But since Obama's policy is not a law there is no court that can rule on it. Therein lies the biggest gap of all in checks and balances...
I don't see why the part they upheld is a big deal anyways. It's no different than when I police officer stops you for a ticket he checks to see if you have a driver's license. The upheld part is consistent with what police are allowed to do daily across the entire country. He still has to have a reason to stop you.
What difference will it make as the Federal government is not deporting illegal immigratns. They want them here, they want them dependent on the government, they want them to vote. If they wanted reforme they could have had it when the whole government was held by Democrats.

Most of those deported have been criminals, using a program implemented by Obama's ICE agency to have law enforcement officials check immigration status when fingerprinting people in jails.
The Obama administration supports letting illegal immigrants stay in this country if they obey our laws and are working or getting an education. And in case you hadn't noticed, that's why people are (literally) dying to get into this country.

I find you very misleading. Section 3 was the key part and that was ruled unconstitutional. It would have made it a crime in AZ to not carry your papers. It was a "primary offense", meaning police could detain people who they suspected of not carrying their ID. The media is really dropping the ball on this one. They only thing upheld was the state authority's ability to check the status of someone who they already have detained on another, separate, offense. Then if they do find the person they have detained for something else is also here illegally, they can notify the federal authorities about it. That's it. Brewer lost huge on this, but she's so slimy that she's pretending the one thing she got was what people were concerned about. This is false. It was Section 3 the whole time.

If the police stop a driver for a traffic violation, he can ask to see the drivers ID. The only part of this law that would make any difference is making it illegal to work. But this still does not crack down on the employer, so who cares.
It is already illegal to enter/stay without proper documents, and already illegal to use fraudulent documents. Deportation is meaningless because these folks come right back to work. The "papers please" part just creates fear and caution, or moving to other areas that are more lenient.
Beyond the flood across the border, is the problem of the 14th amendment that still allows for "anchor babies." This would be difficult if not impossible to change.
But a reliable eVerify mandate would at least be a start in removing the attraction for illegal immigration. The day Teapublicans legislate against businesses (employers) is the day pigs will fly.

That's the one thing that will largely solve this illegal immigration problem. If we make really stiff penalties for hiring illegal immigrants, no employer will risk it, and without jobs, the illegal immigrants will self-deport - essentially accomplishing what we need - at minimal cost.
I wish the Obama Administration would just enforce the laws, and then we would not have these problems of illegal workers competing with legal residents for the few jobs available.

So the employer should pay, the infant who had no choice should pay, the 90 year old parents should pay, and my coworker should have to pay (by losing his mother) when it was the government's fault to begin with? They acknowledged that they made a mistake but refused to allow anyone to file paperwork to correct it.

So i just read this "breaking news": Obama administration officials announced Monday they are suspending a key program that allowed state and local law enforcement to enforce federal immigration law.
Officials also said Immigration and Customs Enforcement will be SELECTIVE in responding to the expected increase in calls from Arizona and other police agencies about immigration status of people they pull over.
This is bullcrap. This makes me mad how a president can abuse his power.
So even if the cops pull illegals over, the feds have orders from the president to not answer the call for an arrest.

Jess, it's called an individual tax payer identification number. You can get one from the IRS and using it in lieu of a social security number is fine for working. Also you cannot be deported based on your usage of the ITIN vs. a social security number.
This allows illegal's to pay into social security and other forms of tax that they themselves will probably never see any return on.

I understand that makes the child a US citizen. The point is, is that some parents of these children, are simply having the children for the welfare check. That's wrong. If they are not having the child with the intention of getting money out of it, and they need it to support their child, sure give it to them. Jess, ITIN's aren't perfect. You have to file a return to get one, the IRS states they can't be used as proof of eligibility to work; however most employers will allow you to work with one simply for the fact that they can cover their bases and report the worker to the IRS and retain plausible deniability. I'm not sure why the workers you claim you never got one, I suppose there are those who'd rather skimp on the taxes and hide their earnings by falsifying social security numbers. ITINS are becoming more and more accepted; in my home state of Kentucky and others you can even use an ITIN to get a driver's licenses.
I'm sure social security theft happens, but I don't think it is as prevalent as illegal workers themselves, I thank you for actually making coherent augments though, when I get a chance I'll find those links.
I'm all for immigration reform, I think we should start by increasing the number of work visas available to match our need and the demand.

The original source for the first is this: http://www.cis.org/immigrant-welfare-use-2011 from CIS, a notoriously anti-immigration organization. The early parts of the article are drawn right from DHS and are fine, but they get their final conclusion by extrapolating that since they 'believe' (not much support as DHS estimates around 5%) that 10% of all immigrants are here illegally, that 10% of those receiving benefits would also be illegal.
The second article also uses false sampling for its numbers. Not all of them are over-staying visas. Some of them were brought here as children. Some of them came here as adults, started as shop helpers and WORKED their way up. Some of them held those jobs in Mexico, and came here with the knowledge of their trade. I know a lot in the last three examples I've given. My boyfriend is a welder, and my father a machinist, and for a while my brother was in construction, but is now also in machining.
Citizens should come first in this country- you are right. But I don't think that many Americans are out looking for jobs in the fields I'm talking about that can't find work. Take up the problem with the local election office - everything stops at their desk. Yes, it is still illegal for illegal immigrants to accept employment, et cetera. But it's illegal under federal law, not state law. The idea is to keep control of this issue under jurisdiction of the federal government, so that if changes to federal law are made--and a lot of people are trying to make them--they'll apply everywhere, and there won't be the issue of state laws suddenly contradicting the new federal rulings.
As for the part about arresting people under "suspicion" of being here illegally, that part's just unconstitutional. I'm amazed it even made it to the supreme court.

Even if the Supreme Court upheld Arizona, I doubt the state has the money, time or manpower to enforce those laws. It's a political statement more than anything. Don't pass this financial burden down to the states who have to take care of these illegals.

The Arizona law did not supersede federal law. It was trying to enforce the laws that the federal government has been ignoring for many years, many administrations.
Do yourself a favor and read the law Arizona put together. All it does is enforce the law the federal government has on the books. They didn't institute a law that is different from the federal govt. or superscede anything. For disclosure purposes I'm a 2nd generation Mexican American and this annoys me. The Arizona law states you need to carry ID in case you are suspected. Doesn't bother me, I always carry my license anyway.

The Constitution never uses the word immigration, so how is it that the rules for immigrants, and quotas for countries, are set by the federal government and not by the state governments? Although MSN is spinning this as a loss to Arizona, I would disagree. Arizona Police Officers are now required by law to check citizenship of those they come into contact with. It goes without saying that those checks will result in those being in AZ illegal will be turned over to ICE. You see when they record how many illegal immigrants are being deported, and that number goes up, there is a direct corrolation to the number of illegal immigrants being deported. That increase in numbers means that more illegal immigrants are being deported. Since there was a very sharp increase in that number, noting that the illegal immigrants being deported were considered dangerous, that means more illegal immigrants are being deported. That can be directly, and wholly, attributed to the Obama administration. So, bottom line is you are an idiot.

A high number of illegals were reported removed (aka deported) for FY2011. But according to DHS statistics 2X more Illegals were removed (aka deported) during the Bush Administration then under the Obama Administration.

For one, a panel of eight judges, one didn't include herself in this ruling, who were appointed to decide the constitutionality of this law for the country, have decided most of the law was unconstitutional, so it doesn't really matter what you think, the law is unconstitutional. As to constitutionality, what the justices concurred upon was the fact that there are indeed federal laws which, if upheld and followed (and that is the gist of the problem here, non-enforcement of federal immigration laws) should be sufficient for the issues of illegal and legal immigration.
More are being deported because local officials, not federal officials are doing their job by turning the illegals in. Califorinia has been enforcing similar laws to what Arizona instituted.

Given that Immigration says there is no national database of US Citizens, how do they clear you?? For everyone who says they'l just produce a drivers licence, or social security card--those can be faked, forged, etc. If you give them your BC, how do they know the name printed on the BC is indeed you?
And if there s no national database, how long is it going to take to clear you? If you're stopped because your headlight bulb is out, on your way to picking up your child from school, you have to wait until they are done--I'm not sure but I thought I saw something where DHS estimates it'll take about 90 minutes to check someone citizenship during a stop. Will your child's school hold your child for an hour and a half?
And if they decide that they can't determine your citizenship or your proofs are unsatisfactory,will you then be allowed to call someone else to pick up your child? Do you have anyone else?
What if they decide you are illegal and deport you even though you are a citizen? It happened--one example I remember is a 71 year old blind woman in New York, Deolinda Smith-Wilmore. Immigration deported her to the Dominican republic even though she had showed her birth certificate--they said they couldn't tell if it was real or not and deported her anyway.

Every day of the week police officers contact Homeland Security to check the immigration status of a suspect. Police Officers in AZ did this and continue to do this. Nothing's changed!

I agree with inmissouri. I live in Arizona and when I'm pulled over for a traffic violation and asked to show my driver's license, registration, and insurance, I do it. Why? Because you're supposed to have all of those things to legally operate a motor vehicle in this state. I've never once screamed "Profiling!" when asked for those documents.
Not only do I carry my ID everywhere, but am required to produce it on many occasions carrying out business. Why should these foreign invaders not be made to carry theirs?

Mike, the police 'can check the immigration status' of a person stopped by the police which is the key part of the law. By the way, what is wrong with having all people' carry ID's. All of us have to carry ID's each day for all kinds of reasons.
When I was 15 a police officer asked me why was I standing at the street corner and then ask me for ID...what 15 year olds even today carry ID..this happen back in the 60's.
That doesn't make any sense. How is a traffic violation anywhere close to just "being?" I was in a town in upstate NY transferring buses, and Border Patrol checked everyone's IDs; we weren't doing anything wrong, but because of the high population of immigrants in the area, they were checking that bus stop. Simply walking around and being asked to show ID is not the same as being stopped for allegedly (and in most cases actually) breaking the law and being asked for your license which shows you are legally allowed to drive.
The key is that you would have been stopped for a traffic violation, meaining that a ploice officer saw you driving and believed he/she observed you violating the law. As the law requires you to have a driver's license, the police officer is not doing anything unconstitutional by asking for your license. Your citizenship status isn't something a police officer can observe by looking at you, so there is no way to establish reasonable suspicion, unless we make it alw for everyone to carry papers that can be randomly demanded by law enforcement....which is what the Nazis did, by the way.

Federal law already states any immigrant must always carry ID with them, green card, visa whatever. If you go to Europe you're supposed to keep your passport on you. The act of requiring people to carry their ID was not the issue, as that is already widely accepted.

I didn't say anything about a law, (although LEGAL immigrants are required to have their papers on them at all times). There are just so many things that you might need your ID for, I couldn't imagine leaving my house without it.
I understand your concern, however how would you make the decision if someone "seems like they could be illegal?" This law allows this to be at the discretion of the police officers, who are people with their own set of preconceived notions of what an illegal immigrant "seems like."
This is insulting and degrading to the Hispanic population who has been in this country for several generations who would possibly be subject to these requests to prove their citizenship. How would the children of these Hispanic American citizens feel as they stand by and potentially have to watch their parents being asked to prove they belong in this country? The embarrassment and shame would undoubtedly affect their self esteem and more than likely have generations of children who develop hate and disdain for the police--very sad.
FYI- I do agree EVERYONE should carry their ID with them! I am referring to stopping people based upon the way they look in a car or walking around town.

Border patrol are federal agents and that's within their jurisdiction. How do you expect them to enforce border security at or very near the border without checking IDs?
If State or local police were asking for ID as proof of citizenship without have real probable cause, that is clearly out of their jurisdiction and would be akin to what the Arizona case was about.
Theres a big difference between a photo ID and youre legal papers...How many of you carry your birth certificate and SS card on your person...Ill wager that very few do, and if you do, youre a fool. ANYONE can have a photo ID...

It is already federal law that requires immigrants to carry identification and proof of immigration status on them at all times. It is not until they are naturalized citizens that the requirement goes away. So what is so unconstitutional about that? Tsanders1 in South Dakota you must have your birth certificate, social security card and bills or papers to prove your place of residence to get a drivers license and if you are a woman you must prove name change if your last name is not the same as on your birth certificate and I am fine with that as I am here legally. You also must have your proof of insurance and registration in your vehicle. So that would mean that no matter what your color/race you must prove you are here legally.
Many years ago I would frequently visit Mexican border towns. Often I would be accompanied by Hispanic friends. These friends were NEVER challenged when they declared their American citizenship when returning to the states. I asked a (hispanic) border guard once if they just always let folks cross if they say they are American. He claimed that they could just look and tell if the person really was American. He also claimed that it was just as easy to tell non-citizens of European extraction. Face it, Brits really do look different from Americans. It's not a racist thing...it's a fact of life.

You carry the same type of ID every normal US citizen has. My wife, on the other hand, is a green-card holder. It's not the same. To be required to carry separate "forn'er ID" is concerning. It's unnerving to us. When traveling within the US, we always present TSA her US drivers license (just like you! - aren't you special?!) We feel very uncomfortable showing strangers that she is a permanent resident because of the nationalism and xenophobia that come of you clearly have! A driver's license most definitely doesn't announce "forn'er"; it says 'Mercan. Aren't so you proud of yourself?
The only people who don't carry ID are people trying to hide something. I have to show my ID at least once a day, sometimes multiple times a day. And I am a white American male.
So when you have a person of Mexican origin standing on the corner of Home Depot with several other persons of Mexican origin waiting for a truck to pull up and say he needs 6 workers for the day, a law enforcement officer is not supposed to be able to use that as a justifiable reason to check their ID to ensure they are legal immigrants or legal citizens? How about if you have a person of Mexican origin being questioned at a job site where several other persons of Mexican origin are working because something was stolen from the job site? How about if that individual being questioned can't speak a word of English? Why should he be protected by the constitution of the United States? Why should the supreme court make it illegal to check his ID? Profiling is just using logic and reason to conclude the possibility of someone breaking the law. Having them prove otherwise by simply showing their driver license should not be an issue. If you catch someone in your back yard at night wearing all black clothes, holding a bag filled with hammers, screwdrivers, pry bars, and bolt cutters, would you suspect that he might be there to break into your house? If you are an idiot then maybe not, but chances are he is. So a mexican working with a group of mexicans doing a job that everyone knows is done by illegal immigrants is PROBABLY an illegal immigrant. All he has to do is flash his ID showing otherwise and he is good to go. What is the problem?
argumentative- absolutely. I was just replying to Butch's thought that there are no laws that require you to have an ID. Which I guess would be fine if you never wanted to drive, buy anything with an age requirement, open a bank account, get a job, etc, etc. Personally, as a minimum, I make sure I have my DL, insurance card, and work ID (need it for the time clock) with me every day.
Ohio- in my state, you're required to show your birth certificate and SS card, plus some other items, in order to get your DL. A police officer can check to make sure it's a valid ID. So our DL's do show proof of citizenship.
So if the federal government refuses to enforce immigration laws and the states aren't allowed to enforce federal law for them and pressure the federal government into enforcing its own laws, where does that leave us, the people, and the states? I haven't read the decision yet, but this decision appears to leave those who have to bear the burden of illegal immigration without recourse.

In an earlier article DHS told the justices that there is no way to legally prove one is a citizen of the US except through the passport registration system.
DLs can be faked/forged; SS cards can be stolen, faked, forged; BC can be stolen and how do they know that actually IS you on that BC without going back to the office and asking the state that issued it for your original? Puerto Rico has such a problem with people's birth certificates being stolen/forged/faked that a few years back they revoked ALL their people's BC's and reissued them new ones.
So if you have to have a passport to prove you're a citizen, how many people have passports? Last I heard the State department says 117 million Americans have a passport--that's 38%. So what happens to the other 62%?

I am completely for enforcing the laws and revamping the system to stop illegal immigration, however these particular law of basically racial profiling makes me upset. I am a military spouse and I think of all the Hispanic WW2 and other Veterans I work with when I volunteer at the VA hospital and how much they have sacrificed for this country. When I think about these little old men being pulled over or just stopped period and asking them- who have sacrificed so very much for this country to prove they belong here- it kills me. They look like any other brown Hispanic person- so how the heck would they tell? I would be very interested in reading the guidelines AZ is giving to their law enforcement officers detailing what qualifies someone to fall under the suspicion of being illegal thus subject to being asked to prove their citizenship. I see many lawsuits coming AZ way for those who are wrongfully detained for this portion of the law.

Immigration- Build a fence on both borders, Make 100% of the materials for the fence manufactured in the US. Have a moratorium on new immigration. Have all immigrants register, must give fingerprint, DNA, documents from home country, resident address. They will pay 1500.00 fine and once all criteria is met the will be granted temporary citizenship. We will do background checks from the country or origin and if they are not criminals or fugitives they can stay after 7 sevens if they violate no law and file taxes they will be granted full citizenship. As for guest workers they will to the register, fingerprint, DNA and background check they will pay 500.00 dollars per year to work in the US. Anyone that doesn't comply will be deported immediately.

NOBODY has read the entire Obamacare law so how can we know if you support all of it. I worked in health insurance and only know parts of it, what I do know is that it will help some like college students under 26 and hurt the elderly who have only been working and paying taxes for 50 plus years. And the poor well they will just have to pay the fines for not having insurance but that will be less than $300 plus a month for bad insurance. But that is off subject IF the federal government had been doing its job Arizona would not have had to try to pass the laws.

I find it strange that Americans are so uninformed or so dumb that they do not understand that business is pro illegal immigration. It is so obvious; businesses have displaced the entire bottom of the labor market that was occupied by Americans with Mexicans.
The only thing business is against is being taxed to educate these immigrants and help them to raise their standard of living.
Don't you wish that you were as informed, as you think you are. Take a look at the jobs the illegals do and tell me that business hires these people. Most business' could care less about the legal status of these workers because they do not hire them, directly. Most illegals are put to work by some subcontractor (most legal Hispanics) which bids for the work. All payment is made to the subcontractors.
The laws are already on the books about hiring illegals but they aren't enforced. Business should be held responsible for the illegal practices of their subs, Right?

Sigh, no one really read the Court's decision carefully. What was the biggest complaint? That law enforcement at state level could demand ID if a crime was either happening, or had happened. Now, the Court upheld demand of documentation by law enforcement.
The DOJ is working overtime to insure that illegals can VOTE, witness their attacks on states looking to clear voter registration. The DOJ isn't too good when it comes to American Citizens but if you are an illegal alien, the DOJ and Obama are the bestest friends you can hope for.

Actually while I was reading your blogs I was doing something none of you dyed in the wool Kool-aid drinkers on either side were doing. I was listening to the courts arguements that were being played on c-span. I heard the arguement for the state of Az and The arguement for the government and really if you want to win these cases completely you better come up with better arguement as to why it is wrong for the state of Az to follow federal statues that require asking the federal government if a person a legal resident of the US. Because that is one statute brought up by the court. Section 2 of 1070 makes jurisdictions within Arizona follow that statue instead of ignoring it.

Brewer was doing what the vast majority of Arizona citizens wanted her to do. Let me tell you a little true story. My wifes social security number was used by an illegal to get job. That illegal didn't pay the income taxes on their wages. My wife's social security payments were attached by the IRS in order to pay thos taxes. When she requested a W2 form from the company that paid the wages and we actually went to the company's offices to check them out we found out that the person was actually from Mexico. The IRS didn't care about ID theft they just took almost $3000.00 from her retirement income. I did obtain a picture of the woman who used my wifes social and if I ever see her she will get double tapped with 9mm Hydra Shocks.

That is not the issue at all. Arizona overstepped it's authority. Immigration is a Federal issue, not a state one.

Okay, first and foremost, the state of Arizona was attempting to make themselvers their own little ICE in violation of the Constitution. Those duties and rights that the Constitution specifically enumerates as belonging to the federal government cannot be superseded by state laws. Second, as part of the Constitution, there is protection from unwarrented questioning, search and detention. Simply, there would be many Americans and legal citizens that would be pulled over and under this law for no other reason that they didn't look "right." There rights would be affected by this law and, as a result, it was rightly struck down. Just because you don't look like you might be from another country does not mean my neighbor needs to be harrassed.
The issue is not immigration. Arizona took the approach that if the Feds aren't going to enforce the laws, they would. The Court said even if the Feds aren't enforcing the laws, it is still their law to enforce (or not, as it were).
Let me try- the law allowed cops with "probable cause" to have someone prove their status. This means you will have a police state checking anyone and everyone they see fir.
