A day after his endorsement of same-sex marriage, President Obama was already expected to break a record at a fundraiser hosted by George Clooney. NBC's Kristen Welker reports.
President Barack Obama’s words of personal support Wednesday for same-sex marriages don't change the laws in 38 states that define marriage as a union between one man and one woman.
Obama aides told The Associated Press that he continues to believe that marriage is an issue best decided by the states. But the president's comments are also a reminder that at least some aspects of the marriage issue will almost certainly be decided by federal judges, not voters.
For example, there’s ongoing litigation in two federal appeals courts over the constitutionality of the 1996 law signed by President Bill Clinton, the Defense of Marriage Act.

The plaintiffs contend that the law violates the U.S. Constitution’s guarantee of equal protection by requiring the federal government to deny recognition of the legal marriages of same-sex couples in Massachusetts and other states.
The high court may also decide whether to hear a case from California on the constitutionality of Proposition 8, approved by voters in 2008, which amends the state constitution to define marriage in traditional terms.
Who will be the judges and justices who will decide these cases?
That will partly be decided by the voters in November – will it be Obama or Republican Republican Mitt Romney who will have the power to nominate judges over the next four years?
Ed Gillespie, Romney Campaign Senior Advisor, joins The Daily Rundown's Chuck Todd to discuss Mitt Romney's response to the President Obama's same-sex marriage stance, and responds to a Washington Post story in which Romney was accused of bullying while he was in high school.
Voters will also decide whether it will be a Democratic-controlled or a Republican-controlled Senate that will be voting on whether to confirm those judicial nominees.
With Justice Ruth Bader Ginsburg at age 79, Justice Antonin Scalia 76, and Justice Anthony Kennedy 75, it’s entirely possible the next president could appoint two or three justices, as well as dozens of judges to the appeals courts.
To see how high the stakes are, look at the cases before the high court over next couple of years:
- The validity of a crucial section of the 1965 Voting Rights Act (the Shelby County, Ala. case now being considered by a three-judge panel in the court of appeals in Washington, D.C., Circuit);
- More appeals from prisoners being held by the United States at the Guantanamo base;
- And perhaps another immigration battle – especially if the high court splits 4-4 in the Arizona case in which it heard oral arguments last month.
Already on the docket for the Supreme Court term starting in October is a case concerning the use of race and ethnicity as factors in the admissions policy at the University of Texas.
By the time voters cast their ballots in November the court will have delivered its rulings in the challenges to Obama’s landmark health care overhaul and to the Arizona immigration law.
“You really have this amazing combination of not just legally important but politically charged, one might even say divisive, issues all before the court right before the election,” said Curt Levey, executive director of The Committee for Justice, a conservative group that tracks judicial nominations.
“As we get closer to the election and we have these decisions, I think there’s no way to avoid it being one of the top issues in the campaign.”
Some conservatives are chilly toward Romney because they doubt he’s genuinely committed to their principles. But when it comes to judicial nominees, Levey said, “I think it’s clear just from his public statements that he realizes that this is a key issue for conservatives. Even if you are a conservative cynic about Romney and don’t believe that he’s a real conservative, I think you can be reassured that – taking the cynical point of view – he certainly has to throw some bones to conservatives.”
Asked to name his favorite Supreme Court justice in a FOX News debate last December, Romney named four: Scalia, Chief Justice John Roberts, Justice Clarence Thomas, and Justice Samuel Alito – all Republican appointees.
Progressives, of course, also recognize the consequences for the courts of what voters decide in November.
Judith Schaeffer, vice president of the Constitutional Accountability Center, a progressive think tank said: "With the Supreme Court as starkly divided ideologically as it is today, the stakes this November are quite high. On so many issues of critical importance, the Constitution truly is at a crossroads before the Court under Chief Justice John Roberts. That said, every presidential election is important to the future of the federal judiciary, given the President's constitutional responsibility to nominate Supreme Court Justices and lower court judges.”
There’s a pent-up frustration among Democrats that Obama has not been able to get more of his judicial nominees confirmed by the Senate. According to the liberal group Alliance for Justice, there are now 15 vacancies on the federal courts of appeals and 78 district court vacancies.
“Until this month, the number of vacancies on the federal courts had stood at 80 or more for more than 1,000 days, a harmful vacancy crisis caused by unprecedented obstruction of the president’s nominees by conservatives in the Senate. Progressives, like most Americans, are tired of the gridlock in Washington, which has left the third branch of government one of its worst casualties,” Schaeffer said.
Obama has appointed 144 of the judges and justices now serving on the federal bench. In his first term, George W. Bush had 204 confirmed, according to the Federal Judicial Center.


The President has already proved he doesn't care about State laws and the Constitution. He has fought against both from day one. He makes his own rules and gives himself dictatorship style executive power. The Supreme court for over 200 years has ruled , that the laws on a valid marriage is a State issue; some states allow a girl as young as 13 to be married, however if you move to another state you can be arrested for statutory rape; the court will probable follow precedent and allow each state to determine what is a valid marriage, however allow civil contract unions to be enforced !

Obama has signed executive orders telling federal agencies not to enforce duly passed federal statutes. This is not only a violation of his oath of office, it is a violation of the separation of powers in the constitution!!! Obama does see himself as president, he thinks he is a king. He rules by fiat in the form of executive orders whenever he can not get the legislative branch to give him the laws he wants. As bad as Obama has been in his first term, I fear what will happen if he is given a second term where he does not have to worry about getting reelected. The founders did not want a 50%+1 dictatorship. That is why there are three branches to the government. Two houses of legistlature, veto overrides of 2/3's of the representatives and Senators, 2/3's senate and House votes to add ammendments, 3/4's of state legislatures in favor to pass new ammendments to the constitution, and a 60 vote cloture rule in the Senate.
Clearly they understood the problems of a democracy and power greeed to put those safe guards in.

How many more gay teenagers have to commit suicide before the gay community realizes suicides are primarily from inner trauma, in this case probably emotional trauma in early childhood, not primarily from external forces such as bullying - and for which people need support, resolution, and help. Unfortunately, they aren't getting that needed help in the gay community. So who is to blame?

40 states have laws banning gay marriage. We don't really need to worry about the executive branch or the Supreme Court. All that is required is 39 states.
The legislatures of 2/3 of the states in the US would need to call for a convention to amend the constitution and then 3/4 of the states would have to pass the amendment.

the church holds sway with "Holy Matrimony" not marriage. what's really sad about the NC vote was their whole reason for adding Amendment 1 and was stated by one of the "founders" of that movement was because "it's easy to overturn a law but very hard to overturn an amendment". I really thought we, as a nation, would have progressed further.
It just seems, and I may be wrong, that just about every generation there comes this great "moral dilemma" and it involves someone's right to equality. The thing is, homosexuality has been around long before the birth of Christ. It is found in nature. Chimpanzese have been observed having those relationships. I'm not getting into Evoltionism versus Creationism, but seeing as we share many of the same genes as Chimps, is it really that hard to understand? And when they do get equal rights it's not going to cause the human race to go extinct. The court is interested in laws that protect rights of citizens. Civil union laws protect citizens be they gay or straight when it comes to property rights, inheritance rights, visitation rights, power of attorney. As long as citizens are protected the court will agree. The genius of states rights, is it allows states to have civil union laws, legalized pot and prostitution, selling of alcohol.
Bear in mind the Founding Fathers did NOT want Federal government to become big, but wanted states to do what they felt was best for their citizens. It's why you had Protestants, Catholics, Jews, agnostics,different ethnic groups choosing certain states over others.
They even said that in Federal elections like for President, House/Senate ALL citizen of legal age must be allowed to vote. Look at states who have different ages for driving, or in the past, for drinking. There are states who changed drinking ages from 18 to 21 because the Feds said they would stop Fed aid to any state that kept the 18 age.
yes civil unions protect a few rights, but not all. I know death benefits and survivors pensions are not allowed in civil unions. I'd have to ask friends that are gay what others aren't in their "rights".
It's odd, our forefathers had the wherewithal to put "separation of church and state" into our constitution, but it's almost impossible for that to happen with churches elbowing their way to the front of the line screaming "foul" about something they have no right to be involved in.

The Supreme Court has been corrupted by big money interests just like the rest of our government. Democracy, Freedom and equal rights are no longer what this country is about.
The Supreme Courts rating shows more than 60% of Americans have a favorable view of the high court. This is far higher than any other brach of government. So your view of the being corrupt is just not supported by the majority of America. To be fair the Roman historians were not witnesses and only one of them really tried to describe Jesus himself the rest were more descriptions of the Early Church. Still significant in a historical sense though. Also even though I'm agnostic I do think Jesus was a historical person. However, it would be dishonest to act as if questioning that was somehow beyond the bounds of reason.
As to Genesis and its a description of what a Godly marriage should be, I respect your beliefs however those beliefs are irrelevant in terms of US legislation.
Finally as an aside I'm developing a pet peeve with right wing Christians who want to quote the Old Testament for the purpose of bolstering their arguments against equal liberties for homosexuals. Yet when that the same Old Testament is used for examples of other equally condemned activities then suddenly we hear "The Old Testament doesn't apply anymore!" It can't be both ways. Either the Old Testament sword cuts both ways or it doesn't cut at all.
As a Hispanic who is: a conservative, a bisexual and a christian. I cant help but wonder why this is an issue now? Besides the fact that Biden put him (the president) in that spot. Last time I checked being married to my boyfriend doesnt mean I have a job, I am still jobless. Last time I checked being in love doesnt pay the bills. Last time I checked being able to get married didnt result in a reduction of the unemployment or the debt that will be saddling the future generations.
I think it is a distraction from the real issues that are harming this nation. If I were the president I would focus on the real issues and leave the emotional issues on the sidelines until the other problems are under control.

The president's position on this issue is bold and the right one, regardless of the political consequences. The issue will evolve to where it will be easier for other national politicos to adopt a similar public stance in the future.
Bottom line: The majority should never be able to decide the civil rights and liberties of all citizens. And when U.S. military forces defend and fight for the rights and liberties of citizens, they do so for all citizens, not a select group or majority.
We live in a republic. This seems to be lost on many individuals. You are free to do what you want. If you are gay and want to marry move to a State that allows it. If you do not approve of gay marriage move to a State that does not allow it. WHY must the Country all be the same? This was the whole point of limited Federal government and the 18 enumerated powers. We are a County of over 300 million. It is difficult to get 10 people to agree on the correct time of day, much less gay marriage.
...because on the issue of civil rights especially...we all lose if we have a patchwork where some individuals are less than other individuals. It didn't work for state laws prohibiting the races from marrying each other and it won't work here. People need to be free to move from state to state without losing something as fundamental as their marriage status. There are people today who don't agree equal rights apply to all regardless of skin color or gender, but we don't cater to them in the name of "allowing disagreement".
