The Obama administration plans a rule change to help reduce the time illegal immigrant spouses and children are separated from citizen relatives while they try to win legal status in the United States, a senior administration official said Thursday.
Currently, illegal immigrants must leave the country before they can ask the government to waive a three- to 10-year ban on legally coming back to the U.S. The length of the ban depends on how long they have lived in the U.S. without permission.
The official said the new rule would let children and spouses of citizens ask the government to decide on the waiver request before the illegal immigrant heads to his or her home country to apply for a visa. The illegal immigrants still must go home to finish the visa process to come back to the U.S., but getting the waiver ahead of time could reduce the time an illegal immigrant is out of the country.
The official spoke on the condition of anonymity because the proposed policy change had not been made public.
The waiver shift is the latest move by President Barack Obama to make changes to immigration policy without congressional action. Congressional Republicans repeatedly have criticized the administration for policy changes they describe as providing "backdoor amnesty" to illegal immigrants.
Immigrants who do not have criminal records and who have only violated immigration laws can win a waiver if they can prove that their absence would cause an "extreme hardship" for their citizen spouse or parent. The government received about 23,000 hardship applications in 2011 and more than 70 percent were approved, the official said.
Applications for the waiver can take as long as six months to be acted upon, the official said. The new rule is expected to reduce that processing time to just days or weeks, the official added.
"This would streamline the process (and) reduce the time of separation between family members," the official said.
The proposal will be published in the Federal Register on Friday. The official said the administration hopes to change the rule later this year.
Immigration has become a difficult issue for Obama ahead of the November election. As a presidential candidate, he pledged to change what many consider to be a broken immigration system.
To that end, Homeland Security Secretary Janet Napolitano announced plans last year to review some 300,000 pending deportation cases in an effort to target criminal illegal immigrants, repeat immigration law violators and those who pose a national security or public safety threat. Napolitano said the DHS would delay indefinitely the cases of many illegal immigrants who have no criminal record and those who have been arrested for only minor traffic violations or other misdemeanors.
A pilot program to review about 12,000 cases pending in immigration court in Baltimore and Denver was launched in November and ends next week. The review is expected to expand to other jurisdictions later this year.
Immigration and Customs Enforcement Director John Morton also issued a memo in June outlining how immigration authorities could use discretion in deciding which illegal immigrants to arrest and put into deportation proceedings. Morton wrote in the memo that discretion could be used in a variety of cases, including for people with no criminal record and young people brought to the country illegally as children.
Congressional Republicans have decried the policy changes, arguing that the Obama administration is circumventing Congress to essentially provide amnesty to countless illegal immigrants.
Rep. Lamar Smith, R-Texas, who chairs the House Judiciary Committee, has been among the most vocal critics and has accused Obama repeatedly of not enforcing immigration law.
Several attempts at an immigration law overhaul have failed in recent years, including the so-called DREAM Act, which would have allowed for some young illegal immigrants brought to the U.S. as children to earn legal status if they went to college or joined the military.

So Obama wants to do something to make it easier for an "illegal"? What part of "illegal" does he not understand? Why can't he do something for the "legal" citizens of this country?
Obama has deported more illegals than any other President before him, so calling him "weak" in illegal immigration is just partisian rhetoric. And personally, while only ~25% of our legal citizens go to college, offering American citizenship for a young illegal who probably emigrated here as a child, and without consent, to go to college seems just. We need a more educated citizenry. Also, more legal immigrants equals more tax revenue. Now, just how much more money would state governments and the federal government make respectively is a figure i don't know. To me, it seems logical to make those who are not criminals legal citizens and actually contribute to this country seems like a good idea, and speeding up the process is a good first step.

Sure..they came to build a better life and immediately broke the laws of the nation and continue to do so each and every day they stay. As was already pointed out, go try and steal or harm someone and then claim that going to jail (think along the lines of deportation) will be a burden on your spouse or parent; you'd get laughed out of the courtroom as they haul you away.
Why is it that illegal immigrants, people who have broken the very basic of laws, get a pat on the head, a "glad you are here" slap on the back and a "we will help you anyway we can" declaration?
Now, on the flip side, I don't have a problem with the DREAM act in its idea, just some of its provisions and with a chnage in some of those provisions I would support it. I don't blame a child brought here as a child with no way to consent or not consent to being brought across our borders in an illegal manner but an age limit as to when they admit to being illegal needs to be set. In other words, if somoene was brought into the country when they were 3 years old and are now claiming it when they are 40+ (just a figurative age here to make the point), no, that doesn't fly.
As well, any child (or adult by age) that gets that waiver would need to have the restriction placed that they cannot sponsor other illegal family members.

The law is aimed generally at citizens who marry non-citizens. Those non-citizens who marry citizens should have an easy path to citizenship (once the marriage is determined valid of course). The current path demands that the non-citizen return to his/her country while the government decides if they qualify for a waver, but that could take up to 6 months. And if they don't get the waver they have to stay out of the country for 10 years. This is a ridiculous law, banning someone for 10 years. The worst part is to beat the 10 year bar it can often cost upwards of $10,000. The lawyer makes that money, not the government. Why not simplify the process, increase the government fees, reduce what the lawyers make on this process and everyone wins?
And please, if Americans wanted jobs the fields in Alabama were full of rotting food because no one would pick them. Since E-verify started in Utah (I don't live there, just have property there) the fast food industry has been hit with a labor shortage to the point that few if any can stay open past 10.

I could understand if these people tried obtaining legal status in the United States like they should be doing properly, but they don't-- most don't even try. They bloody jump the border for riches, and very very few of them ever do it for "family". Sorry that's just not right. More illegals have been deported while Obama was president is true. That's because of an major increase in border patrol captures and Obama can't really interfere with those. Obama has publicly complained that he hasn't been able to do enough to slow deportations. (Said as an explanation during an interview directed at Latinos.) So the fact is he is weak on illegal immigration. The fact is he would be even weaker on immigration if he could figure out how to stop boarder agents from capturing illegals. Obama has made great strides in reducing the number of deportations for illegals after they are out of reach of the Boarder Patrol.
This new policy is actually counterproductive to the cause. Providing extra incentives to illegally enter the country, and just worry about your citizenship later is only going to encourage more people to break the law.
We need to start with reducing the waiting time to become a citizen for people who are NOT sneaking in. Get rid of that stupid test that revolves around US history. Many natural citizens don't know the answers anyway, so it isn't fair to expect a foreigner to learn them.... unless of course you are willing to revoke legal status of people who were born here and failed US History. Not willing to do that? Okay then...
Apply liability to those that came here illegally as an adult (18+ years). You should be able to determine if they were brought here as children by looking at records of schools they claim to have enrolled in. Those who crossed over as an adult are found guilty and put on automatic probation for a set number of years and give them hefty fines. Base the amounts of these fines on whether or not they've been paying taxes during their stay here. If they've been using someone's social security number illegally they are also convicted of identity theft and the probation period is extended. Fine them for that too. But there are ways that the IRS can audit someone's tax records to determine if more than one person has been using the SS# to pay taxes over the years. Plus there are plenty of identity theft firms that research fraud all the time so we already have technology in place to keep track.
So the incentive for obtaining citizenship the right way is that you are not paying out the a$$ for breaking the law and you don't have a criminal record right off the bat.
People with criminal records both here and in Mexico will be denied citizenship, depending on how many convictions and the nature of the crimes. Violent criminals for example: Hell no, they get deported!
Yes this will require a ton of research. That creates jobs cause the gov't will need to hire a ton of assistants and accountants to work with illegals.
After this is all in place, THEN and only THEN should we entertain the idea of shortening the wait time to re-enter the country. But definitely start with the people who are trying to do it the right way FIRST. Not only for Mexicans, but we need to consider people in other 3rd world countries that have it a lot worse and don't have the option of just jumping the fence. People dealing with genocide, rape, famine, starvation, civil war, etc... People who would consider Mexico a paradise compared to their homeland!
It is time to do what is right and fair to everyone trying to live here. Catering to one nationality for the sake of votes is just as racially biased as those that are accused of being bigots.

Here in Oklahoma the Hispanic population mostly takes the jobs NOBODY else will do. You find them working in McDonalds, roofing houses and working construction. Hard, low-paying jobs that they are happy to have and no white or black American wants. When all the anti-Hispanic legislation starting coming out of our state legislature over the last two years the Chamber of Commerce howled that it would hurt the local economy. And it did. Alabama is experiencing that first hand right now, their new unconstitutional profiling law is causing a mass exodus from that state and is hurting the housing and construction industry because they can't find enough people to do the work.

I heard some interesting statistics about Germany yesterday. German auto workers make on an average of $67. an hour. Their labors get to make the decisions on how the plant will be run. Germany has a form of universal health care AND college education is government paid. Germany is also one of those Euro countries...only one that is doing well.
Somehow our government has been bought by big business and the citizens are getting...excuse my french...screwed. And all this immigration is a part of it. Pay the workers and you will have workers. We had the best economy ever when labor unions were thriving and working for us.

For one thing, immigrants are not eligible for welfare. For another, unauthorized immigrants have a higher rate of participation in the work force, holding down one and oftentimes multiple jobs, than native-born Americans. Virtually ALL Americans on the welfare rolls were born here, and a majority are 'white'. The largest single 'category' on the welfare rolls nationally are the newly formed 'race' of so-called "non-Hispanic Whites" identified in the US Census for the first time in 2010.

And according to the Congressional Budget Office, passage of the DREAM Act will REDUCE the federal budget deficit.

As of September 2011, 1.06 million have been deported by the Obama administration. Even using the "new math", 1.57 million is greater than 1.06 million.
However if Mr Obama wants to deport more, he could start with his illegal alien Uncle Onyango and stop the "backdoor amnesty" he started by executive order to the Dept of Homeland Security in August.

My choice of terminology has no bearing on the central theme of my dissertation. Personally, I am an atheist. I do not subscribe to ANY organized religion. But I do think the teachings of the Rabbi from Nazareth have worth and if more people actually practiced what he preached we'd all be much better off. Do I think he was the son of God? NO, I don't believe there is such an entity. Do I think his philosophy of kindness, generosity, acceptance and tolerance is the path to a better world here on earth? I certainly do.
Try to grow yourself a heart, read what Jesus and the Christian Bible has to say regarding "aliens" or "immigrants" (pick the term you prefer). @ commonsense - no, my point was we are taught to obey the law. If Christ were to comment on this specific question, he would expect people entering this country to do so lawfully. He would have no qualm about illegals being arrested and deported because they broke the law.
That's the limit of my discussion. If you want to carry it further to the whole population of the US, then Christ would not condone someone jumping for joy when someone was arrested, but he would also expect that someone to obey the law and if part of that law included enforcing iimmigrationthen he would expect him to enforce that law too.
You have to be very careful using Christ as an excuse not to enforce or obey a law you don't agree with. Far more often than not that kind of thinking will lead you astray.
I agree with some of the points here, but one I need to call out-commonsense, if you think the illegals are not getting welfare, then you are blind. There is an epidemic of identity theft, and a lot of stolen socials being used by illegals to "legalize" them. Not all of them, but it is rampant. How long ago was it that an article was published about a guy who had some fifty people using his social security number? Utterly destroyed his life, and he had to fight tooth and nail with the SSA to get a new number?
As to the rest of the argument, I think we are all in agreement that the immigration system is broken, and needs to be fixed. The methods to fix it are what is under debate. The point was made that if these people were made legal, they would then be entitled to all kinds of benefits that we just cannot afford, because the lower income earners don't pay taxes. It would strain the system to the breaking point. In this case, tax reform would have to go hand in hand with immigration reform. A graduated flat tax would be one way to solve it, so that everyone would have to pay at least SOMETHING for the services that they receive.
Blanket amnesty is not the answer though, because as others of you have said, it just encourages MORE immigration and abuse of the system. Start with the ones that have been in the system legally reward their hard work. Then work on the ones that came here as kids and had no say in the matter. Throw the rest out and make them work their way back.
Oh, and while they're at it? Change the whole "citizenship at birth" nonsense. Unless you have at least one parent who is a citizen, or possibly even a permanent resident, you should not be granted automatic citizenship. Anchor babies are going to break the system a lot faster than anything else.

Forgiveness doesn't mean you forgo prison or punishment or deportation in this case. Forgiveness doesn't mean you let people snag the front of the line just because they want to 'right' the wrongs they've committed. That's unfair to those the started out doing things legally. Part of repentance is restitution. How does an illegal alien perform restitution? That's a tough one really because the illegal alien has affected more than just the obvious people.

The problem with our immigration laws is we do not allow migrant workers since the 1986 amnesty debacle. Part of that bill did away with the workers visa program so now we have hordes of illegals crossing our borders every day and night. When they get here and make enough money, they pay to bring their entire family here once, rather than take the chance of going home to visit and getting caught trying to sneak in again. Back when we had the worker visa program they could come here legally and work and pay taxes and then go home to visit their loved ones during the holidays and then come back over the border to work the fields again for the next season legally. It was a sane, fair, and humane program. But now through the infinite wisdom of the federal gov they sneak in and then sneak their wife and kids in all at the expense of the taxpayer. After a couple years it becomes cost saving for them especially when they know their kids are going to get a free education as well as a couple of free meals each day and free health care because they have no intention of ever paying. The workers visa program prevented that from happening and also we knew who was coming into this country and for what reason.

Regarding the actual aspect of the article's issues, is the "magnificent" attempt by Mr. Obama to circumvent existing Immigration AND Citizenship laws to be admired? I think not. He evidently has deported less than 2 million law-breaking aliens. Not just the basic laws now on the books broken by those sneaking illegally over our borders and flopping here, but who commit many more crimes once here.
The Pew study and many more put the figure of at least 30,000,000 illegal aliens now residing in the United States. And deporting a tad over 1 million is all he has done? It's less than a grain of dust in the political eye, let alone its effect on our disastrous economy.
I would much prefer to see that these criminals never be allowed to return here. Automatically. If they have relatives left here, how many of them are here legally? Regardless, if they want "to be" with their relatives, let the relatives go where the illegals are residing after deportation where they are citizens.
One last caveat. Look at our laws again. Minor children, including any born here of an illegally here parent, is the citizenship of the parent! The touted "anchor babies" do NOT anchor the parent to our nation; the babies are anchored to their parent in citizenship as well as any other liability for the child's actions. NOT OURS. That means no "entitlements" for a non-citizenship residing here illegally.
That is a general summation, but the details and variations essentially conform to it. It's simple to prove. Just research the actual text of our Federal Law, setting forth requirements for Naturalization (obtaining lawful citizenship by any person a citizen of a non-American country).
The damage that the illegals have foisted on this country far exceeds any convenience to individuals hiring them (illegally), or "liberal" convictions of social workers who, perhaps through ignorance, do not themselves obey the laws of this land.
One last thought. How can the Department of Justice, at Mr. Obama's direction, even begin to attack Arizona's laws which fulfill the laws of the land. Their's is an extensively illogical muddle used to defend the Fed's case. Trying to use one aspect of our Constitution to attack another aspect... and doing it illogically, is unconscionable.
Mr. Obama is NOT allowed, Constitutionally, to "make" new laws. His function is simply to enforce the laws that Congress makes. The "Executive Branch" is too often misunderstood as the word "executive" as a noun is today interpreted to mean head honcho. As a verb, however, "to execute" means in its Constitutional context, to see that Congress's laws are enforced... to execute their mandates, NOT his own.
I just do not like Mr. Obama's rationalizations of his unwieldy positions, like killing our soldiers off by his unratified war against Libya. It's ugly.

You might want to check the polls on Obamacare, both when he forced it through and now.
The high majority of the rich already pay far more taxes than the average middle class. It's the ones that that don't that need to be targeted, and that isn't raising their taxes, it's closing loop holes and making them pay the taxes that they should be already paying. Raising taxes on the rich isn't going to do much towards helping the deficit, yet the liberal politicians give out sound bites like it'll solve all of our problems.
As far as "where are the jobs?", there have been plenty of interviews done on small business owners. It's all the regulations that is raising their costs, along with the uncertianity of what this Administration is going to do next that is part of what is holding back hiring. The rest is just a bad economy.
I don't agree with what Congress is doing (along with the extreme high majority of the citizens). Republicans won't come to the table, and Democrats won't compromise. The president is not using the powers given to him by the constitution. Forcing in his 'recess' appointments are a fine example.

For Herman33189: It's not that Americans are lazy, the difference is in lifestyle. Most Americans grow up and grew up in the middle class lifestyle, living in single family homes. They expect that their working years will also be middle class, where they own their own home. The cost of living for the middle class lifestyle is expensive. Thus working low wage jobs does not afford them a middle class lifestyle.
The lifesytles of a new immigrants from South American countries is not the same as American middle class. Immigrants, living in America, in apartments, often with 2 families sharing the apartmen to afford rentt, working low wages jobs is better than what they had in their home country. Especially with the social programs available in America that provide food, medical care, child care, education and even subsidies for rent, that are not offered by their home country.
What most immigrants don't get is that their here because our country wants them here. The largest segment of the American population, baby boomers are retiring in the next 20 years. All 78 million of them. To fund the social security and medicare for those seniors requires a large working population. That's where the immigrants come into play. They replace the baby boomers, and more importantly, replace them as low wage workers, not the high priced workers the baby boomers were.
America needs low wage, semi skilled laborers to be competitive with other countries in a global economy. America does not need high prices workers which makes goods and services uncompetitive in a global economy.
If immigrants really looked at what's going on, they would see that Mexico started their escalation on the drug war in the last part of 2006 and really got going in 2007, that made Mexico very dangerous to traverse. With the housing industry busting in 2008, which large portions of immigrants worked in, leaving America for their home country traversing Mexico also is impossible. That was done by design.
America wants the immigrants here and stay here, working low wage jobs.
What American style of life? If Americans sold the standard of life to the "comfort" of the technology.
Let me ask you something. In the 50's and the 60's, how many shopping malls did we had in America? Who used to work on Sunday? How many "channels" do you have in your TV? How many TV's in your house?
Americans were giving away those customs to become more technology addicts and forgot about the values that made America great. We used to breakfast or dinner with our parents (and don't you dare to say I don't want), We shared time with our kids and taught them values as family, country. etc
Today we have so many different schedules for work, school, etc that you don't even know when you're gonna spend time with your family. The kids eats in their room or watch their shows on Tv there (they have Tv and cable in the room also). Is not an American issue, is a worldwide issue. Our malls practically are open 24/7/365 (night crews still works there when there is no public inside) If you work in retail forget to have Saturday and Sundays off (some companies requires for certain employees to work Fridays, Saturdays and Sundays mandatory, and if you don't like it, there's the door)
So, the Americans became lazy and rely on the cheaper labor from the illegals who are willing to do whatever for they need the money. I don't see Americans climbing on roofs with 120F to do the job for $7.25/hr (and I won't, because is a dangerous job)

Look, the laws of economics are the most powerful force in the world. So ask yourselves, do we want to eat food grown here, or in Mexico? If the agricultural sector of the economy suddenly began paying a lower middle class salary the price of food would go up. Then when you were at the grocery store forced with the choice between produce from the U.S. and produce from Mexico at half the price you will probably go with the cheaper produce. Essentially ensuring that either way, the person willing to take the lower wage will be the one picking the produce.
Another thought America, stop doing cocaine and maybe then Mexico could finally get rid of it's drug cartels so that people would just stay in Mexico.

You clearly have no global business sense and I imagine working at radio shack affords you vast amounts of time to spew stupid throughout the net. Packaging is in Spanish because many products, (especially dry food like cake mixes) go to both Mexico and the U.S. I work in the autoparts industry and because Mexican law requried us to have warning labels in Spanish and the U.S. didn't require warning labels in any language we just printed warning labels in Spanish for both markets. It saved us around 7 cents a unit. Packages being written in Spanish have little to do with illegal immigration.

If we really wanted to cut illegal immigration by at least 80% we need only do two things, both of which would actually save the US tremendous amounts of money; with an optional 3rd thing to seal the deal.
If we dealt with at least the first 2, it would reduce our nation's burden significantly. Dealing with the 3rd would be icing on the cake, but I believe it is not as necessary.
In any sense, Obama would never broach these issues. There's far too much money to be made in the private prison industry and far too many government workers employed in the DEA and police departments to let go of a police-state mentality. Additionally, if you're KB Home or any number of other construction contractors, you've got a lot riding on being able to undercut the market-rate for labor on construction projects. And finally, truly taking an effective approach to dealing with illegal immigration is going to play against all of the interest groups that want to see it continue unabashed.

We cannot make laws ex post facto (i.e. after the fact).
The anchor children are here to stay. And Obama is working to pass a rule that would expedite the rate at which they can get their family's citizenship established.
But honestly, this is fine. We've already got laws on the books that allows people to apply for citizenship and we've created a clause that they must first get a proper visa, and must do so from their home country.
As soon as these people have proper documentation, they are part of the system, they cannot work under the table, they cannot commit felonies and disappear into the sea of the untraceable, etc etc etc.
This setup is ok by me, and if it is able to work faster and have more applicants rather than lawbreakers go around it, all the better.

I'm a strong opponent of illegal immigration, but this only makes sense. If you have a citizen with a wife or husband or children who are illegal, those family members will eventually become legal so why punish them?
However, no law rule such as this should be enacted until we roll out E-Verify nationwide.

I'm personally not against this change in the law, and I'm against illegal immigration.
These people are sponsoring these family members for citizenship, and there's already a procedure for doing so. I'd rather allow the process to speed up than to simply continue supporting an under-class of pre-citizens.
I just hope that the US also gets tough on the sponsor for these people's citizenship. I don't want people just being able to get sponsorship, become a citizen, and then apply for every public benefit under the sun without the sponsor feeling the financial pinch first and foremost.

But, when govt and banks make a policy change that advocates that every American should be "entitled to a home" and threw out "common sense" (very uncommon these days), we gave loans to too the those who were NOT credit worthy. As long as the rest of America was doing ok with their 401K, IRAs or stock investments- nobody cared???? Those that were screaming about the danger of this risk of Fed policy, Fannie and Freddie and sub-prime lending (as far back to 2000), too many called them "chicken little" types. The sad thing about the entire mess, is that we saw the same thing happen in Japan (real estate bust) and we "copied" them (go figure- we always criticized them for being copycats). I was one of those "chicken little" types, I got out of the market before the crash, moved my 401K our of equity and was saved from massive losses.
Too many look for who to blame without looking into mirror. Our American culture has become maters at being a vitim, greed and even hate is on the rise.

Johnson's people actually crafted the broad outline of the program then let Congress fill in the blanks for Johnson's further review and approval.

A US citizen has a reasonable and fair process to assure they can marry an reside in the US with a foreign national spouse. There are even avenues for the spouse of a foreign national seeking green card status to stay in the US, although unconventional and could be made easier, to live legally and have a life in the light.
There is no reason under the sun why we should focus on amnesty for people who have a fair and reasonable path to citizenship available to them. If we wish to render change...then streamline the process and reduce the cost for those application. Honor those immigrants and Americans who follow the law by making the "law" user friendly. For those who do not follow the law....then I suppose if they wish to live with their spouse they can make an application to the spouses home country and will probably be required to follow immigration law there. So don't let the door hit you on the way out.

How many of these illegals are actually going to go back to Mexico and follow the rules to come back into the country? The fact that they came into the U.S. illegally proves that they don't have any respect for American law. It's far more likely that they will slip out some night and show up unannounced in a barrio in a city several states away from where they were arrested.
I don't support Obama much at all, but lets put some perspective on this. This change makes it easier on people who are going through the process of becoming legal citizens. It only effects people once they have begun the process. Calling it "backdoor amnesty" is blowing things out of proportion. I have no problem with people wanting to become legal citizens even if they were initially here illegally. I only have issues with people who want to bypass paying taxes and be in this country illegally at their convenience.

What I continue to find amusing is how mean spirited people can become about citizenship. Immigrant hate has been a part of this countries culture since the beginning but it really bothers me that people don't understand that citizenship is really a human rights subject.
Undocumented workers and residents get abused everyday because of their status in this country. Undocumented workers and residents suppress wages by providing a sub minimum wage work force to people who are actually breaking the law by hiring them.
Undocumented workers and residents live and work here because their home country lacks opportunity or security (or both) for their families. Coming to the United States is a no brainer.
All that said, I understand why citizens do noth like them. But really the best way to alleviate the problem is to work closely with Mexico so that it is a safe place to live with plenty of opportunity. We will benefit from that just as much as they will. If Mexico was safe and had as much opportunity as Canada, I might be the one crossing the Rio Grande.

The reasons for voters to make Obama a one term president keep piling up. This guy is doing what he wants to do and not what the American voter wants. He is a weakling compared to other presidents. Our last really strong president, George H Bush used "shock and awe" on Saddam. Obama is weak on foreign policy (Iran), weak leadership on restoring the economy and extremely weak on protecting our borders and sending illegals home. He doesn't protect the interests of our country. Let's send him home (to Hawaii or Chicago).
